Council Chambers 301 West Second Street Roll Call: The meeting was called to order with Mayor McClellan presiding. Present: Mayor McClellan, Councilmembers Cooke, Mullen, Snell, Trevino Absent: Mayor Pro Tem Goodman, Councilmember Himmelblau The Invocation was given by Reverend Raymond Kiser of Memorial United Methodist Church. ANNOUNCEMENT Mayor McClellan announced that the South Austín Evening Lion's Club is beginning a drive to aid the tornado victims in the Wichita Falls Area. The drive will continue through April 21, with Austin Area H.E.B. food stores serving as a collection point for donations. In addition to non-perishable foods the Lion's Club members will also accept clothes and furniture. All goods collected in the drive will be delivered to Wichita Falls after April 21st by Lion Club members. If anyone knows of items that can be donated to the drive and would like a Lion's Club member to pick them up, they can call Fred Nickols, President, South Austin Evening Lion's Club, at work 444-2319, or at home, 441-5527. - CITY OF AUSTIN, TEXAS.. BOYS CLUB WEEK April 12, 1979 Mayor McClellan read a proclamation designating April 15-21 as Boy's Club Week. Accepting the proclamation, with their thanks, were Derek Dorn, Boy of the Year; Clarence Priestly, President of Board, and Don Kromer, Executive Director. Congressman J.J. Pickle joined the Mayor in the presentation of the proclamation. OLYMPIC WEEK Mr. John Stapleton, Chairman of the Olympithon, was in the Council Chamber to accept, with his appreciation, a proclamation read by Councilmember Cooke, declaring the week of April 14-21, 1979 as Olympic Week. PRIVATE PROPERTY WEEK A proclamation read by Mayor McClellan declared the week of April 15-21, 1979 as Private Property Week. Dorothy Wallace, President, Board of Realtors, accepted the proclamation with her thanks and appreciation. HARMONY WEEK John Winkler, Director, and John McFarland, president of the Austin Cord Rangers were in the Council Chamber to accept, with their appreciation, a proclamation read by Mayor McClellan designating April 15-21, 1979 as Harmony week. They thanked the Mayor and Council for the proclamation and introduced Dale Gaus, Gary Ives, Chuck Sampler, Dan Boole and Moe Richter, Cord Rangers. They joined in harmony to sing two songs for Council and members of the audience. SAVE THE WHALES DAY John Perry, who is working with the Save the Whale Coalition, presented whale sculptures to each Councilmember after Mayor McClellan read a proclamation designating April 12, 1979 as Save the Whales Day. Mr. Perry thanked the Mayor and Council for the proclamation. MINUTES APPROVED Councilmember Trevino moved that the Council approve the minutes of the Special Meetings for March 19, 1979 and March 28, 1979 and the Regular Meeting of March 29, 1979. Mr. Trevino introduced Congressman J.J. Pickle and said, "This is a proposal that will involve the Congressman's office as well as some of our local architects. What we would like to present to Council is a program that, in some respects, would deal with some of the policies we have adopted within the past two years. The Council has gone on record for adopting the corridor plan, one that would improve the visual corridors leading into the city and out. We have heard much about the revitalization of downtown and the surrounding neighborhoods and of course we are deeply committed to the economic programs of the city. It would also tie in with the historical preservation we have seen in abundance in Austin during the past few years. We want to say that tonight this is only a presentation. We hope the Council will take it under advisement and refer it to the joint committee of Planning and Community Development and later on instruct the City Manager to develop whatever comprehensive plan may be necessary." Councilmember Trevino then introduced Mr. George Villalva, local architect, who discussed the French Legation project, which, in essence would clear away the entrance to the French Legation. This would create a corridor to east Austin and soften the boundary line of I.H. 35 by having a park. The park would reinforce the landmarks in east Austin which include churches, the state cemetery, • _ CITY OF AUSTIN, TEXAS April 12, 1979 and Huston-Tillotson College. He showed maps and pictures of the proposed idea and pointed out that some of the old houses in the area would be moved and clustered to provide a center for shops and a community center. Mr. Villalva concluded his presentation by saying the park would serve as a visual and noise buffer as well as a psychological buffer. Congressman J.J. Pickle spoke to Council, expressed his delight at being a part of the proposed project for the restoration of the grounds around the French Legation and said that if Council approves and supports the project, he will put the full force of his office to influence other agencies to support the project with financial aid. Mayor McClellan thanked the Congressman, Councilmember Trevino and Mr. Villalva for their presentations. Councilmember Trevino said that many houses have already been rehabilitated in the area, and he will ask Council to allocate some money from the Community Block Grant toward the Legation project. He said he will also ask the City Manager for help in formulation of an economically feasible plan for the Legation development. Motion Councilmember Trevino moved that the Council approve the presentation and authorize the City Manager to make applications for grants with all speed. April 12, 1979 _ CITY OF AUSTIN, TEXAS RAILROAD WARNING SYSTEM AT W. MARY STREET Councilmember Trevino moved that the Council adopt a resolution to come to an agreement with the State Department of Highways and Public Transportation for the installation of an automatic railroad crossing warning system at West Mary Street. The motion, seconded by Councilmember Cooke, carried by the following vote: Ayes: Councilmember Trevino, Mayor McClellan, Councilmembers Cooke, Mullen, Snell Noes: None Absent: Mayor Pro Tem Goodman, Councilmember Himmelblau Mr. Joe Ternus stated: "We're very pleased that this signal crossing can be funded through the federal railroad program. This will allow us to move the fastest of any method to install gates and other protective devices that might be appropriate at this crossing. It would also mean a savings in excess of $50,000.00 to the local taxpayers. We will be paying only 5%. Otherwise we would be paying at least 90% of the $60,000 crossing. So this is both cheaper for the taxpayer and the fastest way to get this intersection improved." PUBLIC HEARING ON PDA FOR INDUSTRY Mayor McClellan opened the public hearing, scheduled for 6:00 Ρ.Μ., on amending the designation of a portion of the Austin Development Plan from Low Density Residential to Planned Development Area for Industry. She said it is her understanding the Planning Commission has given its approval. Mr. Wayne Golden, Planning Department, told Council that the purpose of the change is to permit the location of prospective industry. SWECO is the proposed industry. The company plans to construct and have in operation by late this year a facility, including a two story office building, employing approximately 50 people and plans of growth of approximately 100 employ- ees. To insure a compatibility with land use in the area, the applicant has agreed to restrict property through the Planned Development Area and site plan approach. Springdale Road, and Manor Road, the existing streets, will provide sufficient vehicular access for the proposed use in its initial phases. As development occurs, there may have to be a future review of use proposed. So far there have been no adverse comments from any departments on the proposed location. The Wastewater Department indicates utilities can be made available. Both a subdivision and an approach main is required and because of the proximity to the City of Austin, a building official recommends the building be constructed in conformance with the building code and that signs also will comply with the codes of the City of Austin. The Office of Environmental Management recommends that all the disturbed areas be seeded and sodded after construction is completed. Engineering and Urban Transportation will comment during the subdivision process. SWECO, according to directions given them at the Planning Commission meeting, held a meeting at the LBJ School for interested neighborhood residents to attend. Approximately 25 people attended. Mr. Golden pointed out that the procedure _ CITY OF AUSTIN. TEXAS April 12, 1979 of asking industries to file a site plan and performance standard is a part of the 1961 Master Plan. He said that shortly they will modify that to include it in the new Comprehensive Plan. However, there is no legal require- ment for notification on the applicants but the department does notify all people and all property owners within 300' as a matter of policy, both inside and outside the city. He said an ad is placed in the newspaper prior to a Council hearing so everyone will know about it. Councilmember Snell asked why the meeting was held so far away from the neighborhood involved. Mr. Golden answered that LBJ is about 4-5 blocks from the location of SWECO. Mr. Snell said that if care is not taken the area will be overdeveloped and said, "I thought we were supposed to bring in a plan for this complete strip, but I've never seen it." Mr. Davidson, City Manager, said he would check on the status of the report. Mr. Merle Moden, University Hills Homeowners Association, appeared to say the plan is nice and they do not oppose construction but wondered what the advantage of a PDA is when they are outside of the city. Ms. Sheila Finneran, Assistant City Attorney, stated the advantage of having the PDA agreement is that it will be filed in the deed records and it will restrict the property to the uses that are in the agreement. Without that, since the property is located outside the city limits, there would be no restrictions on the type of use that could be put on the property. Mr. Moden wondered why SWECO wants to to this, and inquired about their motives. Ms. Finneran said she does not know and suggested he ask them. Mr. Moden thought that a "D" Industrial zoning stamp is being put on the property. Mayor McClellan explained this is outside the city and no zoning is involved, but that the PDA is a lot more restrictive than if the city does not take this route. Miss Finneran stated, "Without this agreement, no matter what they built out there, even a much heavily industrialized plan, if annexed by the city could stay because it would be a non-conforming use." Mr. Moden said it was his understanding if the land is ever annexed by the city it would come in as Interim "D". Miss Finneran and Mr. Albert DeLaRosa, also city attorney, told him that the land would come in as Interim "A" and subsequently it would be zoned. Mr. Moden then asked what the potential cost will be to the city. He understands there is an engineering report which says $191,000 will be spent to connect the site and wonders how much of this will be borne by the City of Austin. He said he felt the University Hills Association would be opposed to the plant because of the implied "D" Industrial zoning next to a residential neighborhood. Mr. Curtis Johnson, Director of Water and Wastewater, stated, "There is going to be a requirement of an approach main. To the best of my knowledge it would not be any additional oversize and I think it would all be the investment of SWECO." Mr. Charles Lambert, real estate broker, agent for SWECO, appeared before Council. He described the property as being at the intersection of old Manor Road and Springdale Road, just north of Ed Bluestein and just south of 290 East. Several items of importance have been brought up, and he said, "I have before me the fiscal requirements as submitted by the City Engineering Division to City Planning on the subdivision application that was turned _ CITY OF AUSTIN, TEXAS April 12, 1979 in. The fiscal requirements are in the neighborhood of $190,000.00. Of this requirement, there's only a very small portion that is to be paid for by the city. It concerns some 1800' of 12" water line to be placed on Springdale Road along the front of the property. The city will pay for the cost of 1/3 of this. The SWECO Corporation will pay 2/3 of the cost because all they would really need would be an 8" line. They really don't even need the 8" line to serve their plant. They are also going to be required to pay for the cost of installation of an 8" line along Old Manor Road, which they will never use. They will also pay $125,000.00 to provide sewer facilities. All of that cost will be borne by SWECO; none by the city. I would also like to say, in their behalf, that these people have bent over backwards to comply with every request that has been asked of them. My understanding of the PDA is that this gives the city a binding contract with the applicant in which they agree to perform certain things and to restrict their operations within that agreement." He pointed out that the area is sparsely populated with Southwestern Bell and Rollins Advertising being the only structures. The cost of the land and the drainage problems make it undesirable for housing. Mr. Lambert, in answer to Councilmember Mullen's question concerning the benefit to SWECO, answered that this will be their world headquarters and they want to be good neighbors. In talking to the Planning Department, they found that PDA would achieve that end. ... Ms. Joan Bartz, Zoning Committee Chairman, University Hills Homeowners Association, appeared to state for the record that the Association is opposed to the amendment of the Austin Development Area for industry for the 29 acre tract located at Springdale Road and Old Manor Road. The organization is opposed to the implied designation of the area for industrial usage and feels that this puts an industrial taint and bias on the area for the future. They feel such a designation would be a signal to all subsequent land development that this is an industrial area. UHHA does not agree with this premise. Major past development in this northeast area has been primarily residential and academic in nature. UHHA, continued Ms. Bartz, is aware that thru the PDA process the landowner agrees to abide by certain criteria for development of the land. However UHHA does not understand or agree with the need to place an official 'industrial' usage on the 29 acres as part of this PDA request. A more acceptable designation would be 'light industrial' on that portion of the tract actually housing the plant with the remainder of the tract left within the low residential usage category presently in effect. UHHA suggested another option would be immediate annexation of the land, thereby placing it under the city's zoning regulations which allows for the type of mixed zoning outlined above. Mrs. Bartz then questioned the cost of the water line. Mr. Curtis Johnson, Director of Water and Wastewater, said along one side of the plant site it is anticipated to put in a 12" waterline and the normal 12/8 cost would be applicable for the city to pay for that portion. It will be about 1800 feet and the cost will be around $6.00 a foot. Councilmember Mullen asked if the city would recover the costs. Mr. Davidson answered it will enable the city to serve future customers. CITY OF AUSTIN, TEXAS April 12, 1979 Joan Bartz returned to the podium speaking as administrative assistant to County Commissioner David W. Samuelson. She read the following letter from Mr. Samuelson for the record: "I have met with the developers of the SWECO project to be located at the above listed site. My concerns are centered on traffic problems connected with the proposal and road improvements done in conformity to the county's standards, and Master Plan requirements. Springdale Road has a narrow bridge and a present driving width of 28 feet. The county has right-of-way for a final width of 80 feet. Old Manor Road has the same present width of 28 feet with future right-of-way to 70 feet. Additional r.o.w. may be required later. The County will be paying particular attention to the placement of access points to the county roads in question from the plant site. Additionally, the county will be reviewing re speed and weight limits, possible truck routes, final traffic counts for the area, and will review all safety aspects of the project given the existing road system before any county approval is given. As indicated earlier, I can move rapidly to assist in matters such as this if and when I am given proper and adequate advance notification of the needs involved in such a project. The developers have been helpful in providing that information needed by the county on this project. The project developers have indicated a willingness to route plant production traffic away from the LBJ highschool vicinity and to attempt to have most plant construction take place during the three summer months when the school will not be in session. I am requesting that I be kept informed of all developments, hearings, etc., connected with this project." Councilmember Mullen said there may be another alternative. "It may be to modify this ordinance and ask them if they would agree to roll back to the modification when it comes in. We would accomplish the same end and get it away from this deed, which I understand is a heavy problem, and get it into what they want and what the neighborhood wants and just instruct staff to go ahead and begin preparation on an amendment and then they could agree to roll back to that classification whenever it is completed." Ms. Bartz said they would be happy to support the idea. Mr. Greg Mather, Vice-President and General Manager of Oil Field Service Division, SWECO, appeared before Council. He stated that they intend to use their plant site as their world headquarters and market equipment for oil drilling all over the world. He said they chose the proposed plant site for its aesthetic quality and the buildings will take advantage and enhance the aesthetic quality. The constraints placed on them by the PDA contract creates no problem for them. Their only problem is time...they are under pressure because of closing down their Houston plant and hope to April 12, 1979 _ CITY OF AUSTIN, TEXAS complete the Austin plant by November of this year. Councilmember Mullen stated, "What I was talking about doing is giving you the O.K. to go ahead because the problem you are having is not created by you, it's created by our ordinance....amend the ordinance, and then let you come back in with the agreement you will come back in under the new classification as long as it's no more restrictive than what you have here...what you've already agreed to. If we come up with a "DD" classification, or whatever, and it's known it's not industrial and doesn't put a blot on the map as the neighbors say, and we could modify that to where you would roll back to that classification. .... No more restrictive than what we've already agreed to." Councilmember Snell asked what percentage of SWECO employees would be Austin residents, and whether they have an affirmative action program. Mr. Mather answered that 75% of the employees would be recruited from Austin and that they do practice affirmative action. Mayor McClellan suggested action be held for one week while staff looks at options to bring back to Council. Because of time constraints, Mr. Davidson suggested Council can approve what's on the table and bring back an ordinance. Motion Councilmember Cooke moved that the Council close the public hearing and approve the amendment to designate a portion of the Austin Development Plan from Low Density Residential to Planned Development Area for industry; with the stipulation when the ordinance is amended SWECO will automatically be placed on the map with the proper designation and instruct staff to come back with options. In order to accomodate late night and early morning joggers, the Parks and Recreation Department staff and the Parks and Recreation Board recommend that the curfew hours along the Town Lake Hike and Bike Trail be changed from 10:00 p.m. -6:00 a.m. to 12:00 midnight to 5:00 a.m. Motion Mayor McClellan introduced the following ordinance: AN ORDINANCE AMENDING SECTION 23-10 OF THE AUSTIN CITY CODE BY PROVIDING FOR SPECIFIC CURFEWS ON ALL CITY PARKS; SUSPENDING THE RULE REQUIRING THAT ORDINANCES BE READ ON THREE SEPARATE DAYS; AND PROVIDING FOR AN EFFECTIVE DATE. TRENCH BURNERS Ms. Mary Lee of the Citizen's Board of Natural Resources and Environmental Quality presented their report on permit application to Texas Air Control Board for operation of trench burner. Ms. Lee said the Board had, the night before, voted to rescind their recommendation of a permit. They want a limited permit for test purposes, but the Texas Air Control Board does not grant limited permits. She requested a representative from the Environmental Board to attend the prehearing conference. Mr. Davidson said that if the Council wants someone to monitor the hearing, then someone from the City Attorney's office will go to monitor and ask questions. Ms. Sue Edwards, Acting Director, Public Health Department, informed Council that the Texas Air Control Board invites the city to attend and comment. Councilmember Cooke agreed that someone from the city legal staff should be there. Dixon Speas, the consulting firm hired by the city to find a new airport site. Mr. Kusche presented his findings to the Council with a slide presentation. He said the question they are addressing in the report is, "Is there another site that can serve the Austin region?" _ CITY OF AUSTIN, TEXAS April 12, 1979 Their forecasts assume that traffic will grow rapidly under the free market until about 1980. There has been an air traffic growth in Austin in 1978 of over 40%. As this growth continues, Austin will need a new airport site within 8-10 years. Mr. Kusche indicated that 2/3 of the air passengers come from the north/northeast and east/southeast so the airport should be on the east side of town. Then those movements will not have to traverse the community or cross other air traffic patterns. When siting an airport the FAA requires that it be thought of as a regional airport and not just for a particular community. As a result, the consultants believe the center of demand is moving north and that bears on con- sideration of where the site may be. The size of the airport area should be about 32 acres and the area of compatible land use adjacent to the airport should be about 6-7,000 acres. Runways should be two miles long with clear zones on each end of 1/2 mile. Trying to find an area near Austin with this geometry is difficult. Mr. Kusche told Council their forecasts require 6-7,000 automobile parking places with a 1,000 car garage; a 30gate terminal of two units that can be incremented; and a lay-out that will maximize the opportunity for aviation related development adjacent to the runway system. Initially, Mr. Kusche related, they took all the topographic and cultural maps available from USGS and the planning agencies, ignoring many planning factors, and just looked at topography, drainage and access roads. After scanning the maps and doing field reconnaisance, they came up with 51 sites, which can be bunched in five search areas. (A) San Marcos, Lockhart and Kyle. (B) Colorado River, but in conflict with the 100-year flood plain and access problems. (C) Sites immediately east of Austin along 290, up to Elgin, north to Coupland and north to Pflugerville, appeared to be the most likely area for accomodating the airport. (D) Williamson County has a number of excellent sites near Hutto and Taylor but they were asked not to consider an airport in that area. (E) Southwest full of development and potential development clear to Liberty Hill. After consideration of all sites, Mr. Kusche said they narrowed the possible sites to four general locations: Pflugerville East: a mile northeast of Pflugerville where a proposed runway would intersect Pfluger Lane. This site is 17 miles from the business district, but there is sufficient space to build the ideal airport to accomodate Austin's needs through the turn of the century. Decker Lake: eight miles from the central business district, but the land is twice as expensive as the alternatives and has problems of space limitations. Manor East: this site is best suited for Austin's projected expansion, a half-mile norhteast of Manor where the proposed runway would stretch northward from the intersection of Texas 973 and U.S. 290. Noise problems may affect the nearby community of New Katy. Mr. Kusche told Council his firm has scheduled public hearings in Manor May 8, and in Pflugerville May 9. CITY OF AUSTIN, TEXAS April 12, 1979 Mayor McClellan commented that Council will have public hearings before choosing the final site. Councilmember Cooke wanted to know when the consulting firm will recommend a final site. Mr. Kusche answered they hope to make a recommendation in June. He asked Council to have a work session and Mayor McClellan told him when the consultants get to the final step, Council will have a work session before holding public hearings.
