NO ACTION TAKEN ON AGENDA ITEM The Council took no action on consideration of extending the moratorium on subdivision platting, zoning and sewer connections for certain lands located within the Barton Creek Watershed. EMPLOYMENT OF HANDICAPPED MR. JIM CANNON, Mayor's Commission on Employment of Handicapped, presented the following recommendations for the creation of an office of service for the handicapped. He said the Director of this office would serve the community of the handicapped in the following ways: "We recommend that the City of Austin create an office of service for the Handicapped. The director of this office would serve the Community of the Handicapped in a number of ways. 1. Monitor the City of Austin hiring practices as related to handicapped persons to promote the hiring of the handicapped. 2. Monitor City operations including but not limited to: a. City government compliance to regulations and/or b. Legislation related to accessibility of City buildings and reasonable accommodation for handicapped City employees. • _ CITY OF AUSTIN, TEXAS April 17, 1980 3. Encourage the use of revenue sharing money and other Federal money (when feasible) to finance more programs and services of benefit to the community of the handicapped. For example, their proposed office would promote development of an accessibility code and a strong City curb cut program. 4. Promote reasonable accommodation in all City human service programs to insure handicapped citizens can be served in a fashion that is at least equal to services received by the nonhandicapped. 5. The office should carry liaison responsibility to various public and private organization serving and/or interested in the community of the handicapped. 6. The office should have an advisory board composed of handicapped persons, family of handicapped persons or persons who work with and for the handicapped community. The advisory board should have screening responsibilities for job applicants who wish to work in the office of services for the Handicapped. 7. The office should be placed administratively so as to not limit the administrative effectiveness of office operations." Mr. Cannon said he thought the office should be under the City Manager or Assistant City Manager. Mayor McClellan asked for a report as quickly as possible. Mr. Daron Butler, Assistant City Manager, told her they can have a report in 30 days. METROPOLITAN ROADWAY PLAN Council had before them for consideration the Metropolitan Roadway Plan. Dr. Jim Benson, Director of Urban Transportation, discussed the plan and the options proposed. Motion Councilmember Cooke moved that the Council delete Arterial 7 from the Plan. One is a Special Permit by the Development Assistance for Rehabilitation, a non-profit organization formed exclusively for the rehabilitation of ex-offenders. That Special Permit has been appealed on Planning Commission's split vote 5-4 to approve the Special Permit. At the time the Planning Commission was considering the Special Permit it was discovered that the applicant would also need more intensive zoning. At the time the Special Permit was heard "AA" Residence zoning was found to be existing on the tract and the Zoning Ordinance requires that "A" Residence zoning must be approved for this use to be carried on at this location. A zoning application was then filed for "C" Commercial for this one acre property and the Planning Commission on a vote of 5-0 recommended that "A" residential be granted. So this evening you have
April 17, 1980 _ CITY OF AUSTIN, TEXAS a Special Permit appealed that if granted would permit the eleemosynary institution for ex-offenders and the zoning, if approved, would permit that operation to exist. The Planning Commission's recommendation is that "A" residential zoning be passed and second, that if the Special Permit is approved that it have a one-year limitation, that the Commission have an opportunity to look at it after one year of operation and see whether or not the Permit should be continued." VINCENT GILES, President, Cavalier Park Neighborhood Association, appeared before Council to state he is asking for denial of the zoning request. It is the opinion of the neighborhood that a half-way house would devalue their homes. He presented a petition of over 150 names of neighborhood residents who are opposed to the granting of a Special Permit. He said they have nothing against the concept of the half-way house but wondered why everything which is objectionable is put in east Austin. Mr. Giles pointed out that recently an individual, who is a counselor for a half-way house, shot his wife. He said if such a person is a model for ex-offenders, he fears for the families in the neighborhood. SISTO C. RAMIREZ, representing the applicant for the zoning change, described the location and said it was isolated and not an integral part of the neighborhood. Councilmember Himmelblau asked him why they are moving the half-way house from its present location. Mr. Ramirez told her the property has been sold and turned into a barbershop. He said he thought the neighborhood has a misconception of what a half-way house is. CHARLES SULLIVAN appeared in support of Development Assistance for Rehabilitation. He told Council the half-way houses reduce the number of people who will return to prison. He cited the way the system has worked in other parts of the country and said it is necessary to have a program like this in Austin. MR. CLAWSON appeared before Council to oppose the permit request. He said there is no transportation provided for the men who will live in the house and they can't have cars. He felt the neighborhood does not need the institution. MAYES JONES, who works for Texas Rehabilitation Commission, said he does not think the half-way house as proposed has been planned out. BUD FLYNN told Council he has a friend who is an ex-felon who has paid his debt. He said society makes offenders pay over and over again and thinks marijuana should be legalized. SHIRLEY GILES, a resident of Parliamentary Drive, is against the halfway house. She said she has two boys to raise and felt their community would be vulnerable to outside influences. She felt the house should not be in a neighborhood. MRS. JOAN DARBY, resident of the neighborhood, appeared to support the philosophy of DAR but felt the half-way house should not be so close to their homes. She said the proximity to homes would cause neighborhood tension and urged Council not to grant a Special Permit. April 17, 1980 CITY OF AUSTIN, TEXAS Councilmember Snell stated, "...This Council has always recognized halfway houses and this Council has worked with neighborhoods to get them established This is an example where the half-way house did not do that and I regret that. I don't want to cut anybody off." Motion Councilmember Snell moved that the Council deny the Special Permit and the zoning change. The motion was seconded by Councilmember Goodman. Councilmember Himmelblau stated she is not opposed to the zoning but is opposed to the Special Permit. She said she has always been opposed to placing eleemosynary institutions in "A" residential zoning. Councilmember Trevino stated, "I'm not opposed to having half-way houses in residential neighborhoods and I argued that point when the suggestion was made. I think the point Mr. Snell is making that in the future when such houses are contemplated, they should make contact with that neighborhood and receive acceptance but I would be totally opposed to saying from now on we will not have half-way houses in a residential area." LARRY WILSON, who works at the Crossroads House on East 12th, told Council if they do not let people have a place to stay in a neighborhood the crime rate will go up. He said the residents of half-way houses do not bother children and that some of their residents work for the City and State. EDWIN SCOTT appeared in opposition to the half-way house in the neighborhood but not to the concept. LEWIS HOFF thought their neighborhood does not have the social amenities for this type institution. A man who did not identify himself, representing DAR, stated all the people have said they are not against the concept but are against the house being in a neighborhood. He pointed out the proposed site is all they can afford. Councilmember Goodman concurred with the remarks of Councilmember Trevino and said he also is not in favor of banning all half-way houses from "A" residential. Councilmember Trevino predicted that after tonight it will be difficult to go into any neighborhood with a half-way house. He said he has mixed emotions because he feels people can be rehabilitated. BRANT, Chairman, Energy Conservation Commission, presented two Energy Conservation Awards. The Citizens National Bank received the commercial category award. By use of thermostat locks, electric light exchange, timing devices on air conditioning, and concentrated efforts by all personnel concerned, they were able to reduce their energy consumption by 40%. The second award, in the government category, was presented Austin Independent School District. They have performed an energy audit on all of their buildings resulting in weatherization and retrofit programs that have reduced their energy consumption bill by $67,200 in a single year. They have also introduced energy conservation programs in the school curriculum at all levels of learning. It is being taught in the third grade and junior high as well as the high schools. MR. COLEMAN and MR. JACK LESLIE received the award for the Citizens Bank; and MR. JACK JEFFREY and MS. JANE DEAR received the award for AISD. HUMAN RELATIONS COMMISSION MR. Many contractors are doing shabby work and she requested a public hearing on guidelines. MR. SILVERIO MENDOZA, representing ACORN, also stated contractors for ARA do not do the job they are supposed to do. He requested Council to attend a tour of homes to see for themselves how poorly the repairs are done. POLITICAL ISSUES BUD FLYNN appeared before Council to discuss political issues. He said Austin is the best City and City Council he has ever seen and he will be the next President of the United States. PARADE PERMIT Councilmember Trevino moved that the Council approve the request for a Parade Permit from IRA H. MARSHALL for Beacon Light Lodge #3338, from 1:00 p.m. to 2:00 p.m., Sunday, April 27, 1980, beginning from 1704 East 12th Street to first block east on 12th, second block south on Chicon, 1 block west on Pennsylvania to 1801 Pennsylvania. PETE MARTINEZ, as President, Rainey Street Neighborhood Association, appeared before Council to discuss development in Rainey Neighborhood Area. He asked Council to declare a moratorium on commercial development on Rainey Street. He said he does not want any more development because none of the residents want to move. Mayor McClellan told him Council is not posted for that action this evening, therefore, they cannot do it. She asked Mr. Daron Butler, Assistant City Manager, for a staff report on the area whose boundaries lie from Walnut Creek to 1st to the Lake and IH 35. Councilmember Himmelblau reminded Council they have asked for rehabilitation in this area. Councilmember Trevino said Austin Redevelopment Authority has been asked to give Rainey Street and the Guadalupe area priority. PURCHASE OF LAND FOR A PARK MR. RON ALLEN, President, Balcones Civic Association, appeared before Council to discuss the purchase of land for park purposes. He began by saying he appreciates and commends the action taken on Steck Valley in the Metropolitan Roadway Plan. He said he wanted to find a way for the City to acquire park land in the area because there is a dwindling availability of possible park sites in the Balcones Hills/Westover Hills/Great Hills Neighborhood. Councilmember Cooke suggested the lease/option approach may be the best way. Mr. Daron Butler told him the possibility is being looked at. The bonds for the park land have not yet been sold. FIESTA DEL BARRIO Councilmember Trevino moved that the Council approve the request of MS. ALMA PEREZ for permission to sell beer and food at Fiesta Gardens from 12:00 Noon until 8:00 P.M., Sunday, April 20, 1980, for Third Annual Fiesta Del Barrio. JIM BOWMAN appeared before Council to request the rechannelization of Atkinson Road to its original position to alleviate a terrible traffic problem. Mr. John German, Director of Public Works, stated several options have been looked at and there is a preliminary plan for the opening of traffic. He said it would cost $30,000. Councilmember Snell asked when it could be done. Mr. German told him they will report back in 90 days. Councilmember Goodman moved that the Council instruct the City Manager to instruct staff to proceed with a plan to restore Atkinson Road. BARTON CREEK DEVELOPMENT ORDINANCE The Council had before them for consideration adoption of Barton Creek Development Ordinance. Mayor McClellan referred Council to the copy of "Options Contained in the Proposed Ordinance for Barton Creek Watershed" which they all had. She said they would go through them and if there were no objections to each point, they would be considered approved. Motion Failed for Lack of Second Councilmember Cooke moved that the Council correct Page 10, Line 16 to "120 acres." The motion failed for lack of a second. Mayor McClellan referred to Page 19 of the Ordinance which refers to the Critical Zone. Councilmember Himmelblau stated, "I wanted protection for the completion of MoPac to 360 under construction....and for Barton Skyway if the study shows..." Mayor McClellan said, "You don't want any prejudice on that." Counci Imember Goodman asked, "Mr. Harris, can I insert a sentence there which says, 'This does not prohibit further construction of MoPac to 360, or the Barton Skyway Bridge, if the Council votes to include the latter in the CIP (Capital Improvements Program) project.'" Mayor Pro Tem Mullen said we are still under contract for the extension of MoPac to 290. Councilmember Goodman said, "Why don't we say this..this is not intended to circumvent any other Council decision relating to the southern completion of MoPac. That will cover Betty's point, Mayor Pro Tem Mullen's point, and Barton Skyway." Mr. Harris said he would see to the wording. Councilmember Goodman pointed out that under Edwards Aquifer Overlay Zone, there should be an insertion of (4), which he said is a standard clause they have in several of the other sections and is missing from the draft in front of them. It should say, "All development in the Edwards Aquifer Overlay Zone shall utilize alternative sewage disposal systems." Councilmember Himmelblau pointed out it was also left out of Page 35." Mayor McClellan asked about Page 23. Mayor Pro Tem Mullen said commercial development discussed on the page is something the whole Council should make a decision on. Councilmember Goodman said he is in agreement with the section as stated. (The part under discussion is Page 23-24 beginning with Line 27.) =CITY OF AUSTIN, TEXAS April 17, 1980 KEN MANNING, Sierra Club, spoke about impervious cover and wondered how far they could go without getting into significant water quality degradation. Motion Mayor Pro Tem Mullen moved that the Council adopt Page 23 all the way down to Line 22 with 2 acres, 60% impervious cover, 20% of the tract left in a contiguous natural state as an alternative to 35% impervious cover. (A person can take 35% impervious cover or this route. That way the water that is coming off of there is going to be clear. If they take 35% it's automatically done.) Councilmember Cooke seconded the motion. Friendly Amendment Councilmember Cooke offered a friendly amendment of 25% of the tract undeveloped. Mayor Pro Tem Mullen accepted the friendly amendment. Councilmember Goodman said, "I think if we are going to consider including that, I don't support the motion. The reason is that if we are going to consider control strategies with these particular figures here I think we need to take a closer look at what exactly the effect would be for the City to monitor, the cost involved in developing a particular control strategy that might be proposed. There are many unanswered questions at this point and I would not feel comfortable voting for it." motion. NEAL GRAHAM and a member of the Engineering Department commented on the Substitute Motion Councilmember Goodman made a substitute motion that the Council go with Section (c) bottom of Page 23 and goes to top of Page 24, only, and does not include the option for control strategy. City Attorney Harris clarified the fact this is no longer an interim ordinance. There have been hundreds of hours spent on the ordinance, over Christmas, and since then giving up your time, and citizens that are interested, and I think it's just fantastic. That's what makes Austin great and I appreciate it." Councilmember Trevino: "I'd like to particularly thank Councilmembers Goodman and Mullen for their outstanding work." Mayor McClellan: "A very special thank you to everyone involved. It's been a lot of hard work and I think the Task Force with all their various diversities and opinions have worked cooperatively for many hours and we appreciate it." Councilmember Cooke: "I do commend Councilmembers Goodman and Mullen and I do commend the Task Force and all the citizens who have been involved in this. We appreciate it." Counci Imember Snell: "As we were voting I was looking at the audience and I think they are quite pleased, too." WATER APPROACH MAIN Council had before it a resolution to approve a Water Approach Main. Prior to the vote, JOE RIDDELL appeared before Council and asked them to turn down the approach main because it would serve development in the re-charge area of Barton Creek. Mr. Rodger White, Wastewater Treatment Department, answered a question posed by Councilmember Goodman concerning the payment of the line. He said the City's participation would be less with a 6" line and paying for it depends upon how fast it will be built. Mr. Davidson, City Manager, pointed out the economy of an oversize line prevents Austin from having to do the line over at a future date when a larger line is needed. Mayor Pro Tem Mullen asked if Council denies the oversize if the development will proceed. Mr. White said if it is denied, the development will be stopped. Mr. Davidson told Council in fairness to the applicant who applied under the old approach main policy, Council should approve. Councilmember Himmelblau reminded Council that in 1975 they had deleted distribution of the full agenda because it was an overwhelming task. She said she wanted the policy continued to only let the public have the Agenda outline. She also asked how many people are considered a group. Lee Thomson, Budget Director, said the numbers had not been defined in the guideline, nor how frequently the group meets in order to qualify for registration for the City documents. Some discussion of this followed. BOB BINDER, Austin Study Group, read a statement concerning the participation of citizens in City government. Motion Councilmember Cooke moved that the Council adopt a resolution approving Document Distribution Policy. The motion was seconded by Councilmember Mullen. Friendly Amendment Mayor Pro Tem Mullen offered a friendly amendment for a report back to Council in 30 days concerning distribution. MARILYN SIMPSON asked if it is legal under the Open Records Act to charge for some documents and not others. She asked for a public hearing. Mr. Albert De La Rosa, Assistant City Attorney, stated that under the Open Records Act it specifies records are open, but the governing body can institute a proper fee for their distribution. Substitute Motion Councilmember Goodman moved that the Council set a public hearing for April 24, 1980 at 8:00p.m. on consideration of adopting the Document Distribution Policy. The Mayor suggested they start the May 8th meeting at 3:00p.m. and have it go through the evening hours to see how that format will work. Mayor Pro Tem Mullen expressed his dislike of the policy to allow a speaker at a public hearing to receive extra time from someone in the audience. He felt they should, at the outset, name who is giving up their time, and then be allowed to speak no longer than 15 minutes. Motion Councilmember Cooke moved that the Council limit speaking time of any one individual at a public hearing to 12 minutes. AGENDA ITEM POSTPONED An Item from Council, introduced by Mayor Pro Tem Mullen, Councilmembers Trevino and Snell concerning budget guidelines for FY 1981 funding of Human Services to be reviewed by the Human Services Review Team, has been postponed until May 1, 1980. HOUSING PLAN Council responded to the City Manager's Report on Housing Plan with the following motion: Councilmember Goodman moved that the Council bring back for action the recommendation to obtain $30,000 of CDBG funds for the Housing Plan. JOHNSON City Manager Davidson reported on the request from Mrs. Duc Tu Johnson for office space for Indochinese Refugees Assistance Program. He said the only available space would be in the Armour Building and the cost for renovation would be $10,000. He told Mrs. Johnson he will keep her organization in mind for any other office space. PUBLIC UTILITY REGULATORY POLICIES ACT Mr. Jorge Carrasco, Electric Department, reported on proposed hearing procedures for Austin under the Public Utility Regulatory Policies Act. He told Council they may want a work session or refer this to the Electric Utilities Commission.
