CITY OF AUSTIN, TEXAS- MINUTES OF THE CITY COUNCIL CITY OF AUSTIN, TEXAS Regular Meeting July 17, 1980 6:00 Ρ.Μ. Council Chambers 301 West Second Street The meeting was called to order with Mayor McClellan presiding. Roll Call: Present: Mayor McClellan, Councilmember Cooke, Mayor Pro Tem Goodman, Councilmembers Himmelblau, Mullen, Snell, Trevino Absent: None INVOCATION REVEREND GEORGE RICKER, University United Methodist Church, gave the Invocation. DR. EDMUND HEINSOHN DAYS : July 17-20, 1980 have been proclaimed Dr. Edmund Heinsohn Days, according to a proclamation read by the Mayor. The proclamation was in honor of Dr. Heinsohn's 92nd birthday and his years of service to the City of Austin and his 25 years as pastor of University Methodist Church. Dr. Heinsohn thanked the Mayor for the proclamation. MR. WILLIE KOCUREK, who acted as spokesman for the event, also thanked the Mayor and presented Councilmembers with a birthday cake in honor of Dr. Heinsohn, who expressed his appreciation for the gesture and for the proclamation. _ CITY OF AUSTIN, TEXAS July 17, 1980 MISS EAST AUSTIN PAGEANT DAY MS. WILLIE WILSON, Miss East Austin - 1979, received a proclamation, read by Councilmember Snell, with her thanks and appreciation. The proclamation designated July 18, 1980 as Miss East Austin Pageant Day. EMPLOYEE SUGGESTION AWARDS The following people appeared before Council to receive a Certificate of Merit and a cash award from Mr. Davidson, City Manager, for their suggestions which have been implemented to add to the efficiency of the City department in which they are employed: JAMES A. FIERO, a Fire Lieutenant with seven years service with the City, suggested that a form used by the Fire Department to document its response to special alarms be eliminated as it duplicated information contained on another departmental form. This suggestion results in the cost savings to the City by eliminating employee time spent in completing, typing, filing and storing these forms. Since 3600 forms were filed last year, the savings should be sizable. Mr. Fiero received an award of $150 for identifying an area where the City can eliminate duplication. JAMES ELMAN, a Leader, Equipment Repair, in the City's Vehicle and Equipment Services Department, suggestion was to diagnose and repair power commender problems in the City's emergency vehicles in-house, using an inexpensive bench tester, rather than shipping them to the local factory and will result in first-year cost savings to the City of $1,601. In addition the quicker in-house repair time considerably cuts down-time on these vehicles, which is a sizeable expense to the City. Mr. Elman received a check for $160.10 which is 10% of the first-year's cost savings to the City. GEORGE HOLCOMB, Equipment Operator II, Public Works Department, suggested a new system for regulating the traffic at the street and bridge worksite at Town View which, because of the busy area, has been the site of several serious vehicular accidents. To better regulate the traffic, reduce the speeds of incoming equipment and to eliminate several hilly areas where driver visability was impaired, Mr. Holcomb developed a number of safeguards including a one-way traffic system and use of speed bumps and signs. Mr. Holcomb received an award of $200 for his suggestion. DAVID W. HALL, Engineer III, Urban Transportation Department, suggested a system for warning motorists of icy conditions on City bridges and overpasses, using signs reading "Ice on Bridge" that can be opened and closed by City Police officers already on the road--reduces the response time and costs involved with calling out crews to set up barricades. The shorter response time possible with this new system will ensure that Austin motorists are advised of poor driving conditions as quickly as possible, reducing the potential for serious accidents and injuries. Mr. Hall received a check for $200 for his idea. July 17, 1980 CITY OF AUSTIN, TEXAS CPR BOWLING TOURNAMENT MS. MARTY SEAL appeared before Council to invite them to participate in the CPR Bowling Tournament. On July 2, 1980, a new pumpage record of 147 million gallons per day was set. Attachment A is a table of daily pumpage from June 1, 1980 through Jul July 9, 1980, and Jollyville and Spicewood Reservoir levels from July 1 to July 9, 1980. "At this time, water supply and water treatment plant capacity has posed no problem in meeting the water demands. If demand does not exceed 177 million gallons per day and if sludge handling does not pose a problem, it is anticipated the demand for water will be met. There have, however, been some problems in the distribution system meeting the water demand. This is primarily attributed to inadequate pumping facilities and capacities. As a result, critical situations rapidly develop whenever any equipment failures occur in the distribution system such as the recent failure of a 14,000 gpm pump at the North Austin Pump Station. "This failure, along with the high water demand, resulted in the inability to replenish the Spicewood Reservoir and brought the reservoir to a 2-foot water depth on July 4. A voluntary water conservation effort was requested by the City Manager and with the odd/even lawn watering scheme has relieved the drain on this reservoir to where it has been maintained at suitable levels. "Also, on July 4, the Jollyville Reservoir fell to 24 feet. The conservation effort has likewise helped bring this reservoir back to more suitable operating levels. "The Department is pursuing two (2) proposals to relieve and supplement the pumping load on the North Austin Pump Station and help maintain Spicewood Reservoir levels. The two plans would connect the West Austin Transmission Main to existing mains and thereby push more water to the Spicewood Reservoir. The location of the proposals are shown on Attachment C. 34 _ CITY OF AUSTIN, TEXAS July 17, 1980 1. Install a connecting line from the existing West Austin Transmission Main north of Northland at MoPac Boulevard to the existing 24-inch line in Northland at Balcones Drive. This can be accomplished in an estimated 5 working days with City forces at an estimated cost of $15,000 and should be completed by Monday, July 14. 2. Install a connection between the West Austin Transmission Main as it enters Great Northern Boulevard north of Carlisle Drive to the existing 24-inch water main in Great Northern. This will require a change order to the Phase 3C contract, is estimated to cost $50,000, and will require an estimated 45-60 working days to complete. The City Council will be asked to authorize this work at their July 17 meeting. "Completion of the West Austin Transmission Main from the Davis Plant to Spicewood Reservoir will be the final solution to the replenishment problems in the Spicewood Reservoir that we have encountered this summer. Portions of this project are complete and all remaining portions of the project are under contract and should be completed by summer of 1981. "The 10,000 gpm pump for the Spicewood Pump Station scheduled for contract award by the Council July 17 will help maintain satisfactory operating levels in the Jollyville Reservoir next summer. We feel these improvements will help meet the demands on the Jollyville system and be adequate until the summer of 1982. "Portable pumps have been used at seven locations throughout the system to support existing pump stations and help maintain system pressures. A map of these locations is shown on Attachment B and the sites are listed on Attachment B-1. The cost of the portable pumping this summer from June 19 through July 8, 1980 has been $10,900. Four of the seven pumping locations are within the southwest water systems and portable pumping has taken place during the dry summer for the past 5 years to boost water pressure in these systems. "If the hot and dry weather continues, portable pumping as available will continue to help maintain water pressure. Also, voluntary conservation measures may need to be continued in those service areas where reservoirs cannot be filled to a reasonable operating level. "Additional information will be available on the southwest water systems in the next two weeks and on the northwest water systems in approximately 30 to 60 days." CITY OF AUSTIN, TEXAS July 17, 1980 STATUS OF URBAN DEVELOPMENT ACTION GRANT PROGRAM Mr. Carlos Herrera, Director of Human Services, presented the City Manager Report on the Status of Urban Development Action Grant Program. "We want to take the opportunity today to bring you more information on our recently submitted application to HUD regarding the Urban Development Action Grant. "On July 2nd this year we received notification that we were eligible for UDAG pockets of poverty program. What this means to the City of Austin as a means of stimulus to the economy is that we are now able to put together specific plans to submit to HUD (Housing and Urban Development) to determine whether or not we can bring monies to Austin to stimulate the economy, create new jobs, and hopefully net new tax revenues. The report forwarded to your offices last week included a summary of the types of activities which are eligible under UDAG. It also describes to you several of the projects that have been approved recently by HUD, such as the one in San Antonio which combines housing, office buildings and other activities of that sort. We also have provided for your inspection the maps of the area included, the boundaries of that area, which include to the north the Martin Luther King Boulevard, on the south the Colorado River, on the west Shoal Creek Boulevard, and on the east extending out almost to Ed Bluestein Boulevard. The eastern boundary is Lott Avenue. "In discussing the eligible activities which are being considered by HUD at this time, we want to make sure the City Council, along with the administration, understands that UDAG is used by HUD to make an effort to promote a link or partnership between private investment people and the public sector, which is the City of Austin combining with the UDAG grant. One of the most important aspects HUD will look at in making a determination whether or not to approve any specific plan submitted, it is very important to consider the leveraging effect of the dollars that are being brought from the private sector. They are looking at a 6-1 ratio at the top and a 2-1/2 to 1 ratio on the bottom. Hopefully this type of leveraging effect will stimulate the economy. The other most important factor is the creation of new permanent jobs. These have to be clearly identified and there has to be a heavy emphasis as far as demonstration as to how these jobs will be created and maintained on a permanent basis. If this cannot be done in the application, then it's not going to be looked at favorably. "Many other considerations will go into effect. One of them is competition. UDAG does not work like our CDBG (Community Development Block Grant) program, which is an entitlement grant based on a formula. It is strictly based on the plan that is submitted and it is a nationwide competitive situation. Therefore, it becomes important that we make every effort to put quality plans together for submission of this type of program. In doing so, it will require that everything is clearly understood from the beginning, including the citizen participation process that will be required, including the leveraging effects that will be required, and the time elements that will be required. We have discussed with many of the other cities and people that have represented private developers in similar situations like Austin, particularly during their initial 37 _ CITY OF AUSTIN, TEXAS July 17, 1980 application process. It is a tremendous effort to be undertaken as far as the application. Once the application is completed and submitted, it also should be understood there is a very lengthy process following the submission of the application, which on a normal basis will require 6 months to determine whether or not that particular application will be accepted by HUD or not. The next submission date is October 1. The Department of Human Services will make every effort to have an application ready by that date. It is a highly ambitious deadline to shoot for. We will keep you posted on that particular date, and whether or not we can have anything put together that early. We stress that UDAG is geared toward having a cooperative project generally between the public and private sectors and, therefore, it will be important to have everything clearly understood by everyone out front who will be involved. This will entail some zoning and land use action by City Council and will also entail having the citizens aware of what is taking place in UDAG and those people who are interested in having an application prepared by the City in this regard. We recommend you set a preliminary public hearing for the simple reason of receiving some public sentiment and some feed-back from the public on what type of activities might be undertaken." Mayor McClellan said Council recognizes the tremendous amount of work which will be involved but Council appreciates what they will do. Councilmember Goodman thought a public hearing should be set for next week. Councilmember Cooke said he did not think the public at large understands UDAG, i.e. private sector, community-based organizations, and neighborhood groups. He suggested some outreach sessions and work sessions to give some explanation about UDAG (Urban Development Action Grants) before public hearings. Mayor McClellan asked the City Manager to give Council a recommended format on what should precede public hearings when this comes back on next week's agenda to set a public hearing. ELECTRIC VEHICLE DEMONSTRATION PROJECT. The City Manager's Report on Electric Vehicle Demonstration Project was presented by use of slides by Pat Gregory or the Urban Transportation Department. NORTHWEST PARK AND RIDE SERVICE Dr. Jim Benson, Director of Urban Transportation, presented the City Manager's Report on the Northwest Park and Ride Service. He told Council the service has met with great success and has found great acceptance among the riders. Consideration is now being given to the addition of a third bus. 38 July 17, 1980 CITY OF AUSTIN, TEXAS DISANNEXATION REQUEST BY LOS ALTOS Mr. Jerry Harris, City Attorney, discussed the City Manager Report on Disannexation Request by Los Altos. "The State law does provide rovide that property owners do have the right to request disannexation by the City in the event they believe they are not receiving the same type of governmental and proprietary services from the City that are received by similar areas of municipalities. After the petition has been filed, the City has 90 days to act on the matter of granting the disannexation or denying it. If the City Council denies within the 90 days or does not take any action, then the property owners have the right within 60 days, after the 90 days are expired, to file a lawsuit and have the Court determine whether or not they are receiving substantially similar services that are received by the remainder of the city. In this particular case the 90 days from the filing of petition has expired, so the property owners have 60 days from July 10 to file lawsuit if they care to. "Council is considering the matter tonight and they can listen to the report and on the basis of whether or not Council believes that this area is receiving essentially similar services as other similar areas in the city, the Council can take several actions. They can direct the staff to come back with a disannexation ordinance. They could deny the request at some later date and let the matter be resolved at the Courthouse if that is where it goes." Mr. Lillie reported as follows on City services received by Los Altos: "This project, the Los Altos Condominiums, is located on the west side of Lake Austin at the end of the creek. It includes 41 units on 7-1/4 acres. It was started in 1974. In April, 1976, a sanitary sewer, lift station and water main was approved by the City Water and Wastewater Department for construction to connect to the City system at Lakeshore Drive and Laguna Vista Drive. In July, 1976, the area was annexed to the city by the Council, and in May, 1977, the ordinance that permitted the development of the project was passed by the City Council. I have submitted reports from Chief Dyson, Chief Kirkham and the EMS (Emergency Medical Service) Department regarding services for fire, policy and EMS. TEXAS July 17, 1980 Council decided unanimously to put this item on the July 24, 1980, agenda for action at 3:00 p.m. PHARMACY CONTRACT FOR MEDICAL ASSISTANCE PROGRAM Dr. Albert G. Randall, Director, Austin-Travis County Health Department, presented the following City Manager Report on Pharmacy Contract for Medical Assistance Program: "The current contract with Texas Pharmaceutical Education and Research Foundation (TPERF) for the provision of pharmacy services to the Medical Assistance Program (MAP) recipients expires on July 31, 1980. "As you know, the drug replacement program that has been utilized this year has been less than satisfactory to the participating pharmacists and the dispensing fee of $2.25 is less than their cost of filling a prescription, according to studies conducted by Southwest Econometrics. Moreover, an approximate shortfall of $200,000 could occur over current budget. "In order to correct this situation and to meet the needs of the participants in the program, many of whom were registering complaints with the Medical. Assistance Program Advisory Committee, a review of this program was initiated. Subsequent meetings of staff, contractor, and the local Advisory Pharmacy Committee were held to address the complaints. "As a result of these meetings, alternatives were developed for possible courses of action. Attached is a discussion of these alternatives open for City Council consideration. The report contains four alternatives along with recommendations from the Medical Assistance Program Advisory Committee and the Pharmacy Advisory Board. This Department is pleased with the recommendation, as it provides cost controls and oversight capabilities. "In order for the Council to have an opportunity to discuss these alternatives and for staff to have sufficient lead time for implementation by October 1, we have requested that TPERF continue its current contract at current rates through September 30, 1980. The contract with TPERF allows for a "hold over" if changes changes in the program are being considered. It is suggested that the City Council set a date of July 24 to consider approval of this contract modification. City Manager Davidson told Council next week's agenda will include the consideration of approval of a pharmacy contract for the Medical Assistance Program and the City Health Department, effective October 1, 1980. Councilmember Goodman wondered if during investigation there have been any improprieties discovered, such as splitting the prescription into more than one part so the charge can be made more than once. Dr. Randall said there are some they are currently looking into in conjunction with TPERF. Councilmember Himmelblau said the two refills would cut this out and be a safeguard. Dr. Randall said that at this point there is no evidence this is being done but they are looking into it. They have received complaints to that effect. 40 CITY OF AUSTIN, TEXAS July 17, 1980 WALNUT CREEK METROPOLITAN PARK MASTER PLAN Mr. Leonard Ehrler, Director, Parks and Recreation, presented the Walnut Creek Metropolitan Park Master Plan to the Council. CONGRESS AVENUE IMPROVEMENTS Daron Butler, Assistant City Manager, and Dr. Jim Benson, Director of Urban Transportation, presented reports on the proposed Congress Avenue Improvements. (COPIES ON FILE IN CITY CLERK'S OFFICE.) Councilmember Himmelblau asked why the Landmark Commission took no action. Dr. Benson told her there is no review by them required because there are no Federal funds in the project. The Mayor and Councilmember Snell asked questions concerning the bus schedules and routes. Citizen Communication Re Congress Avenue MR. ROBB SOUTHERLAND appeared before Council to present a petition against the narrowing of Congress Avenue. He said no one is as greatly effected by Congress Avenue as the business owners and employees and said the petition has the signatures of 74 property owners, 138 business managers and 250 employees. He asked Council for a 30-day postponement of their decision in order to give them time to present the position of the group of people opposed to Congress Avenue improvements. MS. ANNE YEAKEL, representing We Care Austin, appeared before Council requesting they do not grant an additional 30 days delay on Congress Avenue. She said the proposed project has been through every proper process and it would prove costly to delay the work further. She said the proposed plan is the result of seven years of study from citizens, staff and merchants. She encouraged Council to vote in favor of the proposed plan for Congress Avenue Improvement. Councilmember Himmelblau asked why the Landmark Commission did not act on it. Ms. Yeakel said they did not request any action. Mayor McClellan said there was no request the Landmark make a decision and there was no requirement they make a decision. She said City Attorney Harris upholds that opinion. Mayor McClellan said everyone commenting on the plan is well-intentioned. Mayor McClellan continued by saying the sidewalks are adequate now, but not attractive, and she thinks this is not the time to reduce traffic in the area. Some day, perhaps, there will be a people mover. She said this decision is a judgement call and she is not sure what a 30-day delay would do for any one. Mayor McClellan suggested we proceed with beautification by modifying the corners and curbs for mobility impaired, improve the sidewalks, plant trees, and keep 6 lanes of traffic. Councilmember Himmelblau said this is the type of beautification she would also prefer. 41 - CITY OF AUSTIN, TEXAS July 17, 1980 Motion Councilmember Himmelblau moved that the Council improve the street corners and sidewalks, plant trees, maintain six lanes of traffic and maintain head-in parking on Congress Avenue. The motion was seconded by Mayor McClellan. Substitute Motion Councilmember Cooke made a substitute motion to adopt a resolution to proceed with Congress Avenue improvements as approved August 1, 1979 and spring of 1980. The motion was seconded by Councilmember Goodman. Councilmember Cooke stated, "We have had six years in this process. We've had two bond elections and for the last 14 months we've had two public hearings. One at the Urban Transportation Department, at least. We've had one on July 19, 1979, from the report drafted June 26, 1979, and distributed to merchants on Congress Avenue. There have been at least 6 public meetings and a great deal of new coverage both by the electronic media and by news print. This is bond money that has already been approved and allocated and will not raise taxes. To delay would mean more money and more redesigning. The drainage project for Congress Avenue was designed into this improvement..Dr. Benson is not trying to defend a plan he created. He is new on the staff and trying to provide his best professional judgement. I think that is what he has done and I think he has done it honorably. And in that judgement, traffic can be managed and there are some alternatives we can consider. I am not a traffic engineer. I will acquiesce to the judgement of our professionals that set the patterns of traffic in our community. A lot has been said and this word has been used and misused that the street will be narrowed.. The street is not going to be narrowed. How can you narrow a street unless you put new buildings on the street. I believe this will stimulate economic activity. I'm in business just like many of you are. And I feel to change my vote after the public testimony and the input. The Mayor asked why the width of the street was not mentioned in our previous discussions. The reason is because the main concern of the merchants was head-in parking on the street and that is what we talked about. No merchant made an issue of 6 lanes to 4 lanes previously. ... I disagree that all the merchants on the street want to go back to 6 lanes. I've heard from Scarbroughs, Snyder-Chenard, Marie Antoinette, Merritt-SchaeferBrown and others who are comfortable with this approach. I realize it is a hard decision and there are many of you who are well-intentioned about what we should do. After all the input I have had over the past three years on this issue, and honorably, I have studied it hard.. I really disagree with those who feel we should go back to six lanes." Councilmember Mullen stated: "I will vote along with Mr. Cooke. I've seen this Council Chamber stacked before by small interest groups..I hope this Council is not swayed by how many people show up here. I haven't voted that way in the past and I don't intend to start now. Unfortunately, a lot of you have not been privy to a lot of the information we have had. I think what you have had is input from cliches and from the people you work for. I think if you will look at your intentions and I don't question anybody's intentions. I hope we can continue to differ on our opinions. Many merchants were here last week in great numbers to speak for this project. They are not here tonight because this is not a public hearing. I think Warren Beaman who was speaking for CITY OF AUSTIN, TEXASJuly 17, 1980 Downtown Unlimited, presented it very well when he said there should not be any winners or losers in this situation. Everybody here is trying to do what they think is best for Austin. When I vote for Councilmember Cooke's motion to proceed, I will be voting for what I think is best for Austin in the future. It may differ from many of you here tonight but I do think it is best for Austin," Councilmember Goodman said, "I seconded the motion and would like to thank Don Able and John Gray, though I disagree with their position, for their input and advice and particularly Robb Southerland for his efforts to present the views of those on Congress Avenue. I think we can sometime soon look back on this project and hopefully know that tonight we made the right decision." Mayor McClellan commented, "I respectfully disagree about delay. Even if we proceed with the current plan, which it looks like will happen, that's not going to occur for some months so I do not see where there will be any more money eaten up. I think there is a misconception if this Council perceives there is only one group for the plan. It's also a misconception to assume the only group opposing this plan is is the Austin National Bank because I have been in all sorts of unusual places during the course of the week and I've had all sorts of people talk to me about retaining the six lanes on Congress Avenue. I disagree with you, Lee, that this is a violation of the public trust to keep six lanes. We went back over the CIP (Capital Improvements Program) and what the public actually voted on, you might toss it back the other way and say you are violating what you voted on in the CIP and bond package to go with the program subsequently proposed, but I wouldn't say that either. This body is elected to make decisions and we often change those decisions. Particularly, if we are presented with new evidence in matters we have not considered before. ..I strongly support retaining the six lanes and proceeding immediately with the beautification project and I think we have adequate funds to do it with from 11th to the bridge." Mr. Langley said he has met with people in the community but are not able to agree on a common ground. They want to reduce the present zoning to a lower industrial zoning, possibly "DL" Light Industrial, and will submit a site plan when it is developed. Allowance will be made for buffers away from the school and the residential neighborhood including deletion of curb cuts, green belt and anything else required by City Planning. MS. HORTENSE appeared before Council and asked for "A" Residence zoning. RUDI MONTEYA, Principal for Brooke Elementary School, asked for residential zoning. Councilmember Mullen asked when the school was built. Mr. Lillie told him in 1954 and the property was zoned "D" Industrial in the 30's or 40's which was typical of that time because schools were also zoned "D". "A". He said having houses on the property will create more traffic for school children than what he proposes to have there. Mr. Albert DeLaRosa, Assistant City Attorney, said the Planning Department has received a letter from the attorneys for the trust objecting to a zoning change, therefore, it will take 6 votes of the Council to change the zoning. Plan. PAT GREGORY, Urban Transportation Department, explained the Transition MARTHA ARBUCKLE, member of the Urban Transportation Commission and Chairman of the Task Force, said the Transition Plan is a good working document and she endorses it 100%. She feels the plan will enable people to become more productive. She said she would like to see the use of more small vehicles. KAREN BARETTA spoke in favor of the plan and said special transit should not be cut back. JIM CANNON, President of MIGHT, spoke in favor of the plan. JAMES TIPPITT told Council he uses the transit services and the buses are needed. GEORGE TRACHTER, Chairman of the Mayor's Committee, hopes 50% of the buses will be converted by 1984 and 100% by the year 2000. Special transit buses make it possible for handicapped to lead better lives. RICHARD LAVELLO, Austin Association of Retarded Citizens, said the mentally retarded and handicapped need to receive special services too. He said a broader definition is needed for use of the special transit system. MR. SCARBROUGH, member of MIGHT, spoke in favor of Mr. Labella's suggestion. -CITY OF AUSTIN, TEXAS July 17, 1980 WANDA DYER, Executive Director of Rural Transportation System, said she is in empathy with Austin's job of trying to efficiently schedule and run a transportation system for transportation disadvantaged persons. She feels the development of the 504 Transition Plan is really effective, but is concerned that the vans being used now will probably be retired in December and there is no provision in the plan for replacement of the vehicles. She said there will be a gap of over a year and a half in service when only five vehicles will be run and Ms. Dyer thinks provisions should be made with cab companies in the interim. JIM BOWEN, one of the participants in the Task Force, thinks there should be some provision to help the handicapped from their homes to the bus stop. He said the pedestrian plan or sidewalk program needs to address this soon. BILL JOHNSON, member of National Federation of the Blind, MIGHT (Mobility Impaired Grappling Hurdles Together), and the Multiple Sclerosis Society, and Austin Association for Retarded Citizens, had several suggestions for Council. He said there should be more seat belts on the vans, seeing eye dogs should not be required to be muzzled, bus schedules should be in large print for those with sight problems, and there should be more than one special transit driver after 6 p.m. PAT POUND, representing herself, said the 504 Transition Plan is an excellent one and she applauds it. HENERRA HERNANDEZ spoke in favor of a one-cent sales tax to at least try to get mass transit and special equipment buses for the handicapped and blind. Assistant City Manager Daron Butler asked the Council, based on the comments heard this evening, to adopt the plan so they can continue to work on it and forward it to UMTA (Urban Mass Transportation Administration) and the Department of Transportation. Councilmember Goodman asked the City Clerk to make a transcript of the hearing so the points brought out by the speakers can be considered in the plan. Councilmember Goodman moved that the Council close the public hearing and approve the Section 504 Transition Plan requiring that all transportation systems be made accessible to mobility impaired persons. TAX APPEALS MR. HAYS HAFFELDER, as well as Mrs. Philip Towery, appeared before Council to discuss tax evaluation of their properties. Mr. Haffelder's property is located at 7103 Guadalupe Street and Mrs. Towery's property is located at 1107 Payne. Mayor McClellan referred them to staff to instruct them in the tax appeal procedure. WEED AND TRASH CONTROL DISCUSSED MR. JOE L. PERRY discussed weed and trash control on vacant property adjacent to the Northwest Mediplex Nursing Home.
