Council Chambers 301 West Second Street The meeting was called to order with Mayor McClellan presiding. Roll Call: Present: Mayor McClellan, Councilmembers Cooke, Goodman, Himmelblau, Mullen, Snell, Mayor Pro Tem Trevino Absent: None The Invocation was given by Reverend Rick Rheem. RESOLUTION FOR DR. ROSS A Resolution, signed by all Councilmembers, was presented to Dr. Raleigh Ross in recognition of the vital part he has been in the Brackenridge Hospital Medical Staff since 1947. Dr. Ross thanked the Mayor and Council for the Resolution and recalled his years of productivity for Brackenridge Hospital. Former Councilmember Dr. Dryden stood at the podium with Dr. Ross as he received the Resolution. BEN HUR SHRINE CIRCUS WEEK Ben Hur Shrine Circus week will be observed September 28 through October 4, according to a proclamation read by the Mayor. TOASTMISTRESS MONTH Members of the Toastmistress Club were in the Council Chamber to receive a proclamation read by Mayor McClellan designating the month of October, 1980 as Toastmistress Month. SETH SEARCY, III, appeared before Council to discuss the Southwest Area Moratorium. He requested effective temperate controls for the area and asked for enough time for the citizen's task force to make a complete study. MR. WAYNE GRONQUIST discussed the Southwest Moratorium and asked Council to appoint Mr. Joe Riddell as a representative of the environmentalists on the Task Force. He pointed out that Council had appointed Dr. Gary Rohlic and Mr. Frank Cooksey to represent the environmentalists and since the builders have two representatives, the environmentalists would also like to have two representatives. He said that Dr. Rohlic has agreed to serve as an advisor for the Task Force. Councilmember Trevino stated, "I agree with the request. I was under the impression when Council went into Executive Session that you all had agreed that Dr. Rohlic would replace Joe Riddell." Councilmember Himmelblau said, "I was also and I have no objections to a change as long as you have his expertise." Motion Councilmember Trevino moved that the Council appoint Joe Riddell in place of Dr. Rohlic on the Task Force to study the Southwest Moratorium. Councilmember Cooke stated, "I'd like to make one comment regarding this issue. I heard what Wayne said, and I appreciate the consideration and misunderstanding but I have to give it to you the way it was presented to me. It's a communication problem but after the discussion went on and I talked to Seth several times about the possible appointments and I said we may do it that night and I was hoping we would and he said, 'We will be very pleased with Dr. Rohlic and very pleased with Mr. Cooksey. Using those names simultaneously it was my understanding you would be satisfied with those two appointments. That may not have been your intent but you said them together and I had no way of knowing that it wasn't your position because we had talked about Dr. Rohlic several times. I too am sorry for the misunderstanding but I just want you to have a little bit of the reflection as I understood the communication." Mr. Searcy said he is sorry about the misunderstanding. _ CITY OF AUSTIN, TEXAS Roll Call on Motion September 25, 1980 Ayes: Councilmembers Goodman, Himmelblau, Mullen, Snell, Mayor Pro Tem Trevino, Mayor McClellan, Councilmember Cooke Noes: None MR. JOE RIDDELL spoke on the Southwest Moratorium. He said the task force has to be a balance between growth and environment and has to have freedom. He said the aquifer has to be protected and that we do not know as much about aquifers as we should. He told Council that if wise decisions are not made now, it will cost millions to correct later. DAVID BLOCH said silt from MoPac will ultimately fill up the aquifer and that the best thing would be to leave the whole matter of water quality up to the task force. PARADE PERMIT Councilmember Mullen moved that the Council approve the request for a Parade Permit requested from Gabriel J. Tamayo, for Austin-Travis Veterans Committee, from 6:30p.m. to 7:30p.m., Tuesday, November 11, 1980, beginning from 2nd and Congress, up Congress Avenue to 11th Street. The motion, seconded by Councilmember Cooke, carried by the following vote: Ayes: Councilmembers Himmelblau, Mullen, Snell, Mayor Pro Tem Trevino, Mayor McClellan, Councilmembers Cooke, Goodman Noes: None REZONING OF BILL MILBURN PROPERTY MR. WILLIAM FLANNERY appeared before Council to discuss rezoning of Bill Milburn property located in Milwood Subdivision at Duval Road (C14-80-138). He said he is against the zoning change and feels the City has not researched this issue enough to be of help to the neighborhood. The site is within 18 shopping centers, with 2 to 3 major ones within two miles of the proposed facility. The shopping center would create too much traffic and the runoff from the shopping center may make Walnut Creek unusable. As an aside he asked about police jurisdiction in the area. He said guns are being fired out there. Mr. Flannery also pointed out that schools do not like to be located near "LR" Local Retail zoning. He also said he would like to see a traffic and pollution analysis. Mayor McClellan told him Council will receive an official letter from the Austin Independent School District (A.I.S.D.) concerning the location of shopping centers next to schools. Councilmember Mullen wondered if permitting Mr. Flannery to speak about a zoning hearing, which had already had a public hearing which is closed, is setting a precedent. Mr. Albert DeLaRosa, Assistant City Attorney, told him he will have to look into this. Since the public hearing has been closed, they may have to ask Council not to pay attention to the remarks being made. He said the regulations for topics discussed under Citizen Communications on the Agenda may have to be revised to not allow discussion of a topic on which the public hearing has been closed. Mayor McClellan stated Council will proceed today but asked the City Attorney to advise Council how to handle this in the future. 1 September 25, 1980 - CITY OF AUSTIN, TEXAS Councilmember Goodman stated, regarding the possibility of new rules for Citizen Communications, "I think that would set a precedent beyond those we are talking about here today and would be the first step toward censorship of citizen communications. That's a five-minute period in which citizens can come and address this Council on any topic. The question I have is whether they should have been entered as emergency items, which I signed those requests. At the City Clerk's request will no longer sign emergency requests unless they are really something that need to be acted upon. And that's a policy I think Council should adopt. But so far as restricting the comments of citizens speaking before us, I don't think it would be constitutional. Councilmember Mullen said he wonders how Council would react if five developers come back next week and make their presentation. DAVID KANE, also speaking on the rezoning request of Bill Milburn, discussed the potential outcome if the rezoning is granted. He said there would be a traffic problem and continued construction could last as much as five years. He said a good compromise proposal would be to have the tract next to the school zoned "0" Office and the rest residential. CITIZEN DID NOT APPEAR MR. BARR MCCLELLAN, who had requested to appear representing Mr. Shed Williams, Jr., regarding exemption from the Slaughter Creek Watershed Moratorium, did not appear. AGENDA ITEMS POSTPONED Councilmember Goodman moved that the Council postpone until October 2, 1980, the following: Approval of Contract: SUHLER TENNIS CONSULTANTS 220 Sunway San Antonio, Texas Pro-Manager of the Pharr Tennis Center, Parks and Recreation. Twelve (12) month contract Estimated revenue: $2,200 annually Consider approval of administrative policy and procedure relating to grant requirements of the U. S. Department of Transportation. Consider authorizing a contract with Peat, Marwick, Mitchell and Company for professional services to include an audit of FY 1979-80 indirect cost plan and the preparation of a city-wide cost allocation plan for FY 1980-81. OPTIONS FOR VEHICLE IMPOUNDMENT Chief of Police Frank Dyson presented the City Manager's Report on Options for Vehicle Impoundment. He reviewed the report he presented to Council last week and said not everything has been fully researched yet. He said he will come back in 30 days with a report, but stated that a possible impoundment lot has been located. He said if Vehicle Service uses one wrecker, then a driver will need to be hired. Chief Dyson said if the City runs its own impoundment lot, then a pound master or clerk needs to be hired. He went on to say they are also exploring the private wrecker service option. Council discussed the hiring of a lobbyist and said they would discuss it later in the evening. Proposed budget includes $51,000 for a lobbyist. Council said $10,000 would be deleted from Employee Suggestion Awards with a notation that it can come from savings in each department. They asked City Manager Davidson to work with them concerning the continuation of the Awards Program, but doing it within each department. Councilmember Goodman asked, at the completion of discussion of the Personnel Department, if any of the cuts just made included any permanent positions. Mr. Flakes replied he will have to terminate two employees. Councilmember Goodman asked, "So if we were to instruct you to cut $36,000 from your department or reassign those people when appropriate, to cut some way to realize $38,000 in savings, and allow you to assign through attrition or whatever, would you prefer that?" Mr. Flakes answered he would much prefer the opportunity to make the decision rather than have the Council instruct him to terminate two employees. Mayor McClellan stated clearly that she does not want a position for the Employee Suggestion Awards program continued, but that the person in that slot be transferred elsewhere. The Mayor asked Mr. Flakes to return by the end of the afternoon and tell Council how he will delete $38,000 from his budget. PUBLIC INFORMATION: By acclamation, Council deleted from Public Information, the Assistant Director position, $29,313; Employee magazine, $14,000; $3,600 out of Council Awards under Special Services. Councilmember Himmelblau said she wants to make certain the $23,000 bed tax is added in. Second and third readings of Ordinance establishing a temporary 30-day moratorium on the processing of certain subdivision plat applications covering land within that portion of the Williamson Creek Watershed which is within the Edwards Aquifer Recharge Zone or the Edwards Aquifer Contributing Recharge Zone being accepted for filing and disapproved. An ordinance to consider amending the 1979-84 Capital Improvements Program by reallocating $307,000 to fund the necessary improvements in water services areas Southwest A and Southwest B. An ordinance to amend establishing the subdivision platting moratorium on land within the Bear Creek Watershed and the Slaughter Creek Watershed to provide for a 180-day moratorium rather than a 60-day moratorium. An Item from Council from Mayor McClellan to consider issuing request for proposals from the private sector for a trial run on the approved Congress Avenue Plan.
