I want clarification on that. (2) He also gave the opinion that it was very likely the section of the National Energy Act that limits the use of natural gas to kitchen purposes only would probably be rescinded by the Reagan Administration the same as the Railroad Commission Order Docket 600 was rescinded earlier because of the new supply of natural gases found. If you could prepare us a memo on those two topics, I would appreciate it." SOUTH AUSTIN SERVICE CENTER Mr. John German, Director of Public Works, presented a report on the South Austin Service Center. He said the Council, in 1979, asked for a site plan, and building elevation plans. Daily and Wann were the architects chosen to do the plans. The total cost of the project will be $8,000,000. The Planning Commission has recommended its approval. TRENT WANN, architect, presented the site plan to the Council. (Copy is on file in City Clerk's Office.) (C14-79-155) The motion, seconded by Councilmember Mullen, carried by the following vote: CITY OF AUSTIN, TEXAS August 19, 1981 Ayes: Councilmembers Deuser, Duncan, Goodman, Mullen, Urdy, Mayor McClellan, Mayor Pro Tem Trevino Noes: None WATER AND WASTEWATER INSPECTION FEES Mr. Bill Bulloch, Director of Water and Wastewater, presented the following report on Water and Wastewater Inspection Fees: "The Water and Wastewater staff has analyzed the existing Water and Wastewater Subdivision Engineering and Inspection Fee structure to determine its appropriate effectiveness. Based on approximately eleven months operating experience, we find that the $200/acre average fee is adequate to generate the funds required to support this expense. However, the use of an average fee schedule is adversely impacting subdividers of tracts that require minimal utility construction while benefiting developers of large tracts with dense utility construction. "I. Original Ordinance The ordinance (800925-JJ) (Attachment A) prescribing and levying the fee contains only one fee of $200 per acre for inspection. Implementation of the ordinance resulted in a schedule of fees not exceeding $200 per acre for various services using the policy memo of January 26, 1981 (Attachment B). "II. Background and Update ز The fee per acre was implemented at $150 or $200 depending on the availability of one or both utilities. Our experience through eleven months shows that it would be more equitable to recognize the variation in work per acre by setting a variable fee per acre. After some investigation and discussion with the Engineering staff, the relationship between estimated cost of improvements and actual inspection cost was selected as a possible basis. Six subdivisions were ued for comparison. The following charts and graph suggest a consistent pattern, though based on limited data. ; "Chart 1.B. The estimated cost of inspection and engineering can be estimated at one and one-third times the actual inspection cost. "Graph 1 (attached) illustrates two points. First, there are no subdivisions in the small sample that fall in the middle ground of $100-$300/acre cost. Second, inpsection per acre ranges from about 1% to 7% of the construction cost per acre and cost of the entire project. "With engineering review added, our costs reach about 9% of the cost of improvements. This cost increase represents the greater staff time required to plan and accept major system improvements. "III. Proposed Ordinance Language for a proposed ordinance: AN ORDINANCE AMENDING ORDINANCE NO. 800925-JJ PART 1. SETTING A SCHEDULE OF FEES FOR WATER AND WASTEWATER DEPARTMENT ENGINEERING REVIEW AND CONSTRUCTION INSPECTION OF SUBDIVISION WATER AND WASTEWATER CONSTRUCTION WITHIN THE SERVICE AREA OF THE CITY OF AUSTIN'S WATER AND WASTEWATER SYSTEM. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: Part 1. There is hereby levied a fee according to the following fee schedule for the review and inspection of water and wastewater utility systems constructed in subdivisions within the service area of the City of Austin's Water and Wastewater system including utility districts. A. Subdivisions presented that require no water or wastewater service or no improvements to existing facilities will be assessed $50 for processing the entire plat. B. Subdivisions that require some central water or wastewater service will be assessed a fee per acre based on estimated total cost of utility improvements as calculated by the Water and Wastewater Department per acre of subdivision based on the graph in Exhibit A. Exceptions to this scale are: 1. Minimum total fee for a plat requiring water or wastewater improvements $200/plat 2. Minimum fee per acre for any water or wastewater improvements $10/acre but not less than $200/plat 3. Maximum fee per acre for any water or wastewater improvements $500/acre C. All fees will be collected at time of final platting. CITY OF AUSTIN, TEXASAugust 19, 1981. Part 2. This ordinance shall become effective immediately and apply to all subdivisions that receive final plat approval by the City Planning Commission on or after Passed and approved: 1981. "IV. Estimated Impact Chart 2 represents the impact of this proposed ordinance revision on current subdivisions. Using only 4 large and 4 small subdivisions shows the proposal to be above the current fee. The total for twelve (12) examples shows a 115% increase in revenues. Residential subdivisions that have high cost per acre due to dense construction bear up to a 150% increase in fees, while low density development like commercial subdivisions pay about 10% of their current assessment. A companion ordinance allowing collection of review and inspection fees on approach mains is proposed for the FY 81-82 Budget. This fee is intended to recover the cost of review and inspection without addressing growth management or land use management." Mr. Bulloch concluded his report by saying to Council if this is the approach they want, he suggests they make it retroactive to August 1, 1981. Councilmember Mullen said he has some problem with the retroactive fee. The Council instructed the City Manager to instruct the staff to bring back an ordinance next week with staff recommendations. WATER CONSERVATION PROGRAM Mr. Bulloch reported on the Status of the Water Conservation Program. He showed Council the kits designed for use by the target group to test the conservation program. He said information will be monitored from a control group of 175 households. CONSTRUCTION ACTIVITY AROUND THE MUNICIPAL BUILDING J. D. Murchison, Assistant Director of Office of Facilities Planning and Construction, appeared before Council to report on Construction Activity Around the Municipal Building. Construction will begin on September 15 and on October 1 the excavation of the upper and lower north parking area will begin. He discussed accessibility to the parking places for Councilmembers and the City Manager. Construction time for the building is estimated at 30 months. Mr. John Baylor, Assistant Director of Property Management, discussed the parking around City Hall and said 32 cars will be assigned spaces at the Travis lot and 30 tax cars will go to the parking garage. Councilmember Deuser asked if there will be any protection from dust and debris for the Mayor and Council cars. CITY OF AUSTIN, TEXAS August 19, 1981 JIM CASEY, representing BWC Associates thought any damage could be handled by their insurance policy, but he said a canopy could be built over the parking lot, and told Council it would be done. Motion Councilmember Mullen moved that the Council adopt a resolution approving amendments to the Option Agreement dated July 31, 1981 between the City of Austin and BWC Associates.
