CITY OF AUSTIN, TEXAS: MINUTES OF THE CITY COUNCIL CITY OF AUSTIN, TEXAS Special Called Council Meeting September 18, 1981 12:00 Noon Council Chambers 301 West Second Street Roll Call: The meeting was called to order with Mayor McClellan presiding. Present: Mayor McClellan, Councilmembers Deuser, Duncan, Goodman, Mullen Absent: Mayor Pro Tem Trevino, Councilmember Urdy Mayor McClellan stated the Special Called Meeting of the Council was a budget public hearing on the following: sidered. ARTS SOCIAL SERVICES 12:00 Noon 3:00 Ρ.Μ. 4:00 Ρ.Μ. 7:00 Ρ.Μ. - - The Mayor also announced there are three ordinances to be con_ CITY OF AUSTIN, TEXAS September 18, 1981 MEETING TIME CHANGED Mayor McClellan introduced the following ordinance: AN ORDINANCE OF THE CITY OF AUSTIN, TEXAS; PROVIDING THAT THE REGULAR STARTING TIME OF THE THURSDAY, SEPTEMBER 24, 1981, CITY COUNCIL MEETING BE CHANGED FROM 3:00P.M. to 9:00 A.M.; SUSPENDING THE RULE REQUIRING THE READING OF ORDINANCES ON THREE SEPARATE DAYS; AND DECLARING AN EMERGENCY. Councilmember Duncan moved that the Council waive the requirement for three readings, declare an emergency and finally pass the ordinance effective immediately. The motion, seconded by Mayor McClellan, carried by the following vote: Ayes: Mayor McClellan, Councilmembers Deuser, Duncan, Goodman, Mullen Noes: None Absent: Mayor Pro Tem Trevino, Councilmember Urdy The Mayor announced that the ordinance had been finally passed. PUBLIC HEARING - ARTS Mayor McClellan announced Council would now begin their budget work session and public hearing on the arts. Austin Chamber of Commerce Councilmember Duncan asked Mr. Vic Mathias, Austin Chamber of Commerce, if they have a break down of expenditures in the area of tourism. Mr. Mathias said tourism requires two reports a year. One is done at the close of the City's fiscal year which is usually about 3-4 inches tall. They also provide the City with an audit from their CPA. They also provide a mid-year report to the City. Mexican American Chamber of Commerce Mr. Gus Garcia said they file the same report with the City. Arts Commission Presentation Paul Lesch, Chairman, Arts Commission, discussed the contract process. He said it is long and involved to allow opportunities for input and negotiation. The staff obtains a preliminary estimate on the bed tax in the spring, then applications are due May 1. This year 59 applications were received. Staff then makes detailed recommedations which are mailed out to all applicants so they can comment and respond. In June and July the Commission breaks down in panels and they ask written questions of the applicant at the meetings through staff and make their proposals at a Saturday work session when applicants are allowed to be present and answer _ CITY OF AUSTIN, TEXAS September 18, 1981 questions. Recommendations are finalized at the regular meeting when full presentations are allowed. This year, Mr. Lesch said, they tried to channel as much money downtown as they could. The contracts reflect, also, their interest in fostering cooperation between organizations for the purpose of efficiency and using money to help arts groups help themselves. They put special emphasis this year on the development of minority arts units. Mr. Lesch said they have just been awarded, although the final letter has not come, the entire $20,000 in expansion arts money they have been fighting with the National Endowment for the Arts about for the past 6 months. This money, he said, is not used to displace bed tax money. It is clearly supplemental. Part of the money is a one time disbursement and the groups who are recipients cannot know what the NEA will do next year. The overwhelming precentage of the funds will be used to pay for staff. He said they hope this will break the "catch 22" cycle where the Texas Commission for the Arts and other funding sources legitimately criticize groups for poor administration while other groups ask how they can run programs without staff. After Council asked Mr. Lesch questions concerning bed tax, Mayor McClellan commended him on the hard work which the Arts Commission does. Esparza Andrerris, representing himself, appeared before Council and said that Blacks and Chicanos do not use Laguna Gloria, therefore, if the City is using money for the museum it should be located where the Blacks and Chicanos can use it. Mr. Lesch stated that Laguna Gloria has programs for a large percentage of Mexicans and Blacks and does more for them than any other institution. Mr. Lesch went on to say the amount of money funded to Laguna Gloria is large because traditionally City museums receive the most funding. Joe Liro appeared before Council and said Laguna Gloria's contract with First Federal for art displays, etc., will terminate the first of the year because they need the space. No one else appeared to be heard. Motion Councilmember Mullen moved that the Council close the public hearing, The motion, seconded by Councilmember Deuser, carried by the following vote: Ayes: Councilmembers Deuser, Duncan, Goodman, Mullen, Mayor McClellan Noes: None Absent: Mayor Pro Tem Trevino, Councilmember Urdy -CITY OF AUSTIN, TEXAS. RECESS September 18, 1981 Council recessed its meeting at 1:05 and resumed its recessed meeting at 4:07 p.m. All Councilmembers were present. NOVEMBER ELECTION SET The Council had before them for consideration the following ordinances: Consider an ordinance ordering an election November 3, 1981 relating to the South Texas Nuclear Project. Consider an ordinance ordering an election relating to the amendment of the Fair Housing Ordinance to include sexual orientation as a protected classification. Motion Councilmember Goodman made a motion, seconded by Councilmember Duncan to waive the requirement for three readings and finally pass an ordinance ordering an election November 3, 1981 relating to the South Texas Nuclear Project. Substitute Motion Councilmember Mullen made a substitute motion, seconded by the Mayor to waive the requirement for three readings and finally pass an ordinance ordering an election on November 3, 1981 relating to the South Texas Nuclear Project and to the amendment of the Fair Housing Ordinance to include sexual orientation as a protected classification. Councilmember Deuser was of the opinion that it would be important to include the same wording on the ballot concerning the sexual orientation amendment as there is on the petition. The Mayor agreed. Motion to Divide Question - Died for Lack of Second Councilmember Deuser made a motion to divide the question. There was no second, so motion died. Call for Question Duncan, Goodman There was a Call for Question. Roll call showed the following vote: Ayes: Councilmember Urdy, Mayor Pro Tem Trevino, Councilmembers Noes: Councilmember Mullen, Mayor McClellan, Councilmember Deuser Failed to pass, 2/3 voted needed. _ CITY OF AUSTIN, TEXAS September 18, 1981 Mayor McClellan addressed the issue of STNP by saying this issue has been before the voters six times. She said the people should be asked to speak up about the subject they are interested in and if they want a vote on the fair housing amendment then they should be allowed to have the question included on the November ballot. She said it would save money to have both issues voted on at the same time with the County election. Councilmember Duncan argued that the vote on the Nuke is not related to fair housing. Mayor McClellan stated another election would have to be budgeted for in the amount of $40,000 and that money could be saved to buy things people need. Discussion followed. AUTHORIZING THE SALE OF AUSTIN'S SIXTEEN PERCENT (16%) INTEREST IN THE SOUTH TEXAS PROJECT (NUCLEAR); MAKING PROVISION FOR THE CONDUCT OF THE ELECTION AND OTHER PROVISIONS INCIDENT AND RELATED TO THE PURPOSE OF THIS ORDINANCE; SUSPENDING THE RULE REQUIRING THE READING OF ORDINANCES ON THREE SEPARATE DAYS; AND DECLARING AN EMERGENCY.
