CITY OF AUSTIN, TEXAS MINUTES OF THE CITY COUNCIL CITY OF AUSTIN, TEXAS Regular Meeting October 22, 1981 3:00 Ρ.Μ. Council Chambers 301 West Second Street The meeting, scheduled at 3:00 p.m., was called to order at 3:15 p.m., with Mayor McClellan presiding. Roll Call: Present: Mayor McClellan, Mayor Pro Tem Trevino, Councilmembers of Christ. Absent: Deuser, Duncan, Goodman, Urdy Councilmember Mullen INVOCATION The Invocation was given by Mr. Ray Chester, Brentwood Church Councilmember Mullen entered the Council Chambers at this time. October 22, 1981 -CITY OF AUSTIN, TEXAS CHANGE ORDER Councilmember Goodman moved that the Council adopt a resolution approving a change order in the amount of $937.92 per month for five years to Fisk Telephone System, Inc. for additional telecommunication equipment and installation. The motion, seconded by Mayor McClellan, carried by the following vote: Ayes: Councilmember Urdy, Mayor McClellan, Mayor Pro Tem Trevino, Councilmembers Deuser, Duncan, Goodman, Mullen Noes: None Prior to the vote the Mayor asked why this was not a part of the original RFP. Mr. Solon Bennett, Purchase and Stores, said the consultant, Warner Whitney, recommends this be approved at this time. Council- member Urdy said it bothers him that, during the long process for approval, this was not discovered. Mr. Bennett said the spécifications writer made an error. STABILITY PAYMENTS Councilmember Duncan moved that the Personnel Policies of the City of Austin (Paragraph 14 (a) of Section IV, Compensation) relating to the timing of stability payments to eligible employees, be amended. The motion, seconded by Councilmember Goodman, carried by the following vote: Ayes: Mayor McClellan, Mayor Pro Tem Trevino, Councilmembers Deuser, Duncan, Goodman, Mullen, Urdy Noes: None Prior to the vote, Mayor McClellan said she had a question regarding the tax when the stability pay and the regular pay are paid in a lump sum. Ms. Robinson, Director of Personnel, said the bottom line is the tax is the same. September 22, 1981 CITY OF AUSTIN, TEXAS OFFICE OF NEIGHBORHOOD REVITALIZATION Mayor McClellan introduced the following ordinance: AN ORDINANCE CREATING THE OFFICE OF NEIGHBORHOOD REVITALIZATION; AND WAIVING ANY NECESSITY FOR MORE THAN ONE READING OF AN ORDINANCE ON ANY ONE DAY; AND DECLARING AN EMERGENCY. Councilmember Duncan moved that the Council waive the requirement for three readings, declare an emergency and finally pass the ordi- The motion, seconded by Mayor McClellan, carried by the following nance. vote: Ayes: Mayor Pro Tem Trevino, Councilmembers Deuser, Duncan, Goodman, Mullen, Urdy, Mayor McClellan Noes: None The Mayor announced that the ordinance had been finally passed. Councilmember Deuser asked which version they were acting on, prior to the vote. He said he talked with the City Manager concerning what department this was going to be brought in on. Mr. Muehlenbeck, Acting City Manager, stated, "It will not be specified in the action but I will be glad to place it on the record that this will be an office as has been approved by the City Council that will be reporting directly to the City Manager. That way the office will be able to cut the various lines and pull in the other departments. ... Property Management, and the various departments that will have an impact upon this department. I will be coming back at a later time with some additional ideas for Council but we would like to start off in that direction." Councilmember Mullen said he would like to have the option at some future date to come back and get it moved if it should be. Mr. Muehlenbeck said that is the intent. E3 Ord 1 CITY OF AUSTIN, TEXAS October 22, 1981 FUNDING FOR OFFICE OF NEIGHBORHOOD REVITALIZATION Mayor McClellan introduced the following ordinance: AN ORDINANCE AMENDING THE OPERATING BUDGET OF THE CITY OF AUSTIN FOR THE FISCAL YEAR 1981-1982 BY ALLOCATING $3,198,002 FOR THE PURPOSE OF FUNDING THE OFFICE OF NEIGHBORHOOD REVITALIZATION; SUSPENDING THE RULE REQUIRING THE READING OF ORDINANCES ON THREE SEPARATE DAYS; AND DECLARING AN EMERGENCY. Mayor Pro Tem Trevino moved that the Council waive the requirement for three readings, declare an emergency, and finally pass the ordi- nance. The motion, seconded by Councilmember Duncan, carried by the following vote: Ayes: Mayor Pro Tem Trevino, Councilmembers Deuser, Duncan, Goodman, Mullen, Urdy, Mayor McClellan Noes: None The Mayor announced that the ordinance had been finally passed. Prior to the vote, Councilmembers asked some questions concerning the amount and allocation. CITY OF AUSTIN, TEXAS October 22, 1981 WATER AND WASTEWATER COMMISSION Council had before them for consideration amendments to the ordinance establishing the Water and Wastewater Commission, concerning membership of such commission. They discussed what they wanted as the make-up of the Commission. Mayor McClellan thought other members of the Council had wanted an additional person on the Commission. Councilmember Deuser said he had requested this be placed on the agenda in order to make the ordinance fit with the action. He said he does not want to see the restriction removed that there be no more than two people indirectly involved in the development industry. Councilmember Goodman said he thought their intention was to abolish all specifications. Motion Councilmember Mullen made a motion to abolish all qualifications they had discussed. Councilmember Goodman seconded the motion. Strike and Insert Councilmember Deuser made a motion to strike and insert all of the restrictions of membership except the restriction for the requirement that there be no more than two members of the Commission directly or indirectly involved with the development industry. Councilmember Duncan seconded the motion. More discussion followed concerning what Councilmembers thought the make-up of the Commission should be. Second to Strike and Insert Withdrawn Councilmember Dunoan withdrew his second to the strike and insert. Roll Call on Motion Roll Call on the motion to abolish all qualifications that had been discussed carried by the following vote: Ayes: Councilmember Goodman, Mullen, Urdy, Mayor McClellan, Mayor Pro Tem Trevino Noes: Councilmembers Duncan, Deuser =CITY OF AUSTIN, TEXAS October 22, 1981 ANNOUNCEMENT Mayor McClellan asked Council how they feel about beginning Thursday's meetings later in the day. She suggested 5:00p.m., except for zoning days, when they could begin at 3:00 p.m. After some discussion, it was decided to maintain the meeting time at 3:00 p.m. RECESS Council recessed its meeting at 3:50 p.m. and resumed its recessed meeting at 4:00 p.m. HEALTH PROBLEMS Mr. Art Brown appeared before Council to discuss health problems which occur because some lots in northeast and east Austin are not mowed. Mr. Guymon Phillips, Assistant City Manager, told Mr. Brown that the City will look at the lots and said the whole program of keeping lots cut and free of weeds needs to be revised. CITIZEN DID NOT APPEAR Mr. William Terry Bray, attorney for Lockheed Missiles and Space Company Inc., who had requested to discuss selection of site of proposed plant location.did not appear. NEIGHBORHOOD REVITALIZATION COMMISSION Mr. George Blackburn appeared before Council to discuss improvement of quality of residential rehabilitation work by Neighborhood Revitalization Commission. He said during the time of ARA very little was said about quality. One of the things that effects quality is the number of complaints and how the problems are handled. According to Mr. Blackburn, specifications need upgrading and inspection should be done according to the specifications. Houses should be fixed so people do not complain so often. Mayor McClellan asked Mr. Blackburn to prepare his remarks for them. Councilmember Urdy asked for an analysis of the nature of complaints. RECESS Council recessed its meeting at 4:15 p.m. and resumed its recessed meeting at 5:00 p.m. October 22, 2981 CITY OF AUSTIN, TEXAS PUBLIC HEARING - WELLS BRANCH WASTEWATER LINE Mayor McClellan opened the public hearing, scheduled for 5:00 p.m. to consider granting an easement for and construction of the Wells Branch Wastewater Line within the Walnut Creek Metropolitan Park. Bill Bulloch, Director of Water and Wastewater, appeared and discussed the line. Mr. Ed. Wendler Jr. showed a map to point out that line will be totally out of the creek. No one else appeared to be heard. Motion Councilmember Goodman made a motion, seconded by Councilmember Duncan to close the public hearing and that it be the finding of the City Council that there is no feasible and prudent alternative to the use of this land for water main purposes and that this project includes all reasonable planning to minimize harm to such land as a park; and to adopt a resolution approving dedication of a tract of land as a sanitary easement. The motion carried by the following vote: Ayes: Mayor McClellan, Mayor Pro Tem Trevino, Councilmembers Deuser, Duncan, Goodman, Mullen, Urdy Noes: None RECESS Council recessed its meeting at 5:07 p.m. and resumed its recessed meeting at 5:30p.m. PUBLIC HEARING STREET VACATION Mayor McClellan opened the public hearing scheduled for 5:30 p.m. to consider vacating the following and passage of ordinance: CIRCLE S ROAD right-of-way adjoining Lot 2, Centennial Park, Congress Avenue at Foremost Drive. (Requested by Cunningham and Graves, Inc., representing Crestview Ltd.) • CITY OF AUSTIN, TEXAS Jetober 22, 1981 Mr. John German, Director of Public Works, appeared before Council to state this is in order. No one appeared to be heard. Mayor McClellan introduced the following ordinance: AN ORDINANCE VACATING AND PERPETUALLY CLOSING THAT CERTAIN PORTION OF CIRCLE S ROAD IN THE CITY OF AUSTIN, TRAVIS COUNTY, TEXAS; RETAINING AN EASEMENT FOR ELECTRIC UTILITY AND CABLE TELEVISION PURPOSES; SUSPENDING THE RULE REQUIRING THE READING OF AN ORDINANCE ON THREE SEPARATE DAYS; AND PROVIDING AN EFFECTIVE DATE. Councilmember Goodman moved that the Council close the public hearing, waive the requirement for three readings, declare an emergency and finally pass the ordinance. The motion, seconded by Mayor McClellan, carried by the finally vote: Ayes: Mayor Pro Tem Trevino, Councilmembers Deuser, Goodman, Noes: Urdy, Mayor McClellan None Not in Council Chambers when roll was called: Councilmembers Duncan, Mullen The Mayor announced that the ordinance had been finally passed. =CITY OF AUSTIN, TEXAS: October 22, 1981 POLLING PLACES Mayor McClellan introduced the following ordinance: AN ORDINANCE AMENDING ORDINANCE NO. 810918-A ORDERING AN ELECTION TO BE HELD IN THE CITY OF AUSTIN ON NOVEMBER 3, 1981 ON THE SOUTH TEXAS PROJECT BY SUBSTITUTING A NEW POLLING PLACE FOR PRECINCT NO. 147; SPECIFICALLY CHANGING PRECINCT 147 POLLING PLACE FROM JESTER HALL WEST, ROOM A215-A TO SECOND FLOOR LOBBY, JESTER CENTER WEST; SUSPENDING THE RULE RREQUIRING THE READING OF ORDINANCES ON THREE SEPARATE DAYS; AND DECLARING AN EMERGENCY. Councilmember Goodman moved that the Council waive the requirement for three readings, declare an emergency, and finally pass the ordinance effective immediately.
