Meiszer City Manager Grace Monroe City Clerk Memorandum To: Mayor McClellan called to order the Meeting of the Council scheduled for 1:00 p.m., noting the absence of Councilmembers Deuser, Duncan, Mayor Pro Tem Trevino, Councilmembers Urdy and Goodman, who entered the Council Chamber at 1:05, 1:15, 1:15, 1:15 and 1:35 respectively. INVOCATION The Invocation was given by Reverend Raymond P. Whitfield, Church of the Good Shepherd. Mayor McClellan announced they were waiting for a quorum and as soon as there is one, Council will recess to Executive Session and resume its recessed meeting at 1:30p.m. EXECUTIVE SESSION Mayor McClellan announced Countil will convene in a closed or executive session authorizied by Section 2, of Article 6252-17 V.T.C.S. (The Texas Open Meetings Act) on the following matter: a. South Texas Project - (Pending Litigation - Section 2, Paragraph e) b. South Texas Project - (Sale of Austin's 16% interest (Real Estate), Section 2, Paragraph f) Council Memo 2 RECESS March 11, 1982 Council recessed for its Executive Session at 1:15 p.m. and resumed its recessed meeting at 1:30 p.m. ZONING APPROVED The Council, on Councilmember Deuser's motion, Councilmember Duncan's second, approved the following zoning application: (6-0 Vote, Councilmember Goodman was out of the room.) 11794 Jollyville Rd. GRANTED "LR" ON FOOT PRINT OF GROCERY STORE ONLY AND "O" ON REST BOAT RACES Council had before them for consideration the approval of motor boat races on Town Lake between Lamar Boulevard and MoPac Boulevard, August 6,7,8, 1982 for the 1982 Austin Aqua Festival. Mayor McClellan said the proposal for the boat races is different than it has been previously. She said she has walked the site many times and thinks it would be a good site for the races. It will mean a closing of the area for only 13½ hours on one weekend. The Mayor pointed out that the Fest nights are noisy and disturb the people living in the area. She said this year the Council is dealing with people of good faith and asked them to vote on its own merit. Mayor McClellan told Council she will vote yes. Mayor Pro Tem Trevino said the issue is not one of a question of honesty and integrity. He pointed out the first group of people to complain about the previous boat races were the Anglos who live in South Austin. Mayor Pro Tem Trevino reminded Council that a former report of the proposed site has said this area is not suitable and wonders why it is now? He will vote no. Councilmember Duncan said he will vote no on the proposal. He has spoken to people about this and has concluded Town Lake is not for spectator sports. Also the noise will be too loud. Councilmember Mullen stated he will vote yes because he believes the races are good for Austin. He said Council is always saying they will not do something that will benefit the majority because a small minority is against. Councilmember Deuser pointed out he would be supportive it were not a major concern of citizens highly impacted. Therefore, he will vote no. Council Memo 3 March 11, 1982 BOAT RACES - (Continued) Mayor McClellan said she respects the different opinions and pointed out the previous report concerned a different part of the lake in a different direction. She said the current proposal is recommended by the Parks Board and thinks the event should be given a chance to prove itself. Councilmember Urdy said he had stated he would vote against the races if there is serious opposition and he feels the area is not designed for spectator sports.and should not be considered for spectator sports. Motion Councilmember Mullen made a motion, seconded by the Mayor to approve motor boat races on Town Lake between Lamar Boulevard and MoPac Boulevard August 6, 7,8, 1982 for the 1982 Austin Aqua Festival. Councilmember Goodman asked this be delayed one more week so Council can study further. He said he would like the opportunity to create harmony in the community. A vote today would mean the races would fail. If the vote is held there is a slim possibility they might pass and said the alternatives should be pursued, Councilmember Duncan recommended alternate sites be considered. Motion The Council unanimously agreed to approve the motion of Councilmember Goodman, seconded by Mayor McClellan to consider the boat races March 18, 1982 at 1:30 Ρ.Μ. EXECUTIVE SESSION Mayor McClellan announced Council would meet in Executive Session authorized by Section 2, Paragraph f, of Article 6252-17, V.T.C.S. (The Texas Open Meetings Act) on the following matter: South Texas Project. (6-0 Vote, Councilmember Deuser out of the room.) Mr. Leonard Ehrler, Director of Parks and Recreation, told Council, "We have been contacted by Notre Dame University, Wichita State University, Kansas State University, the University of Minnesota and the University of Nebraska for the period between March 13 and March 26 at various times and asked that their rowing teams be allowed to use the lake for their spring training and in order to do this safely they have asked permission to use a power launch." PUBLIC HEARING SHEPHERD MOUNTAN TRACT - Mayor McClellan opened the hearing, scheduled for 2:30 P.M. to consider amending Ordinance No. 810820-B (Water and Wastewater Service Area Ordinance) to include Shepherd Mountain tract. Mayor McClellan said there had been a request for a continuance of the public hearing at another date. Mayor Pro Tem Trevino read the following letter from David Armbrust, dated March 9, 1982, addressed to Mayor and Council: "On behalf of Doyle Wilson I respectfully request the Council postpone or continue the public hearing and action on Item G.1, amendment to the Water and Wastewater Service Area Ordinance to include Shepherd Mountain tract until March 25." No one appeared to be heard. Motion The Council, on Councilmember Mullen's motion, Mayor Pro Tem Trevino's Council Memo HEARING - (Continued) 12 March 11, 1982 second, voted to continue the public hearing until March 25, 1982 at 3:30 p.m. (6-0 Vote, Councilmember Deuser was out of the room.) Councilmember Duncan pointed out that Mr. Wilson will not go before the Texas Water Commission for approval of a permit before Council has had its hearing on the 25th of March. Mr. Nias, Assistant City Attorney, told Council a 30 day continuance was granted by the Water Commission this morning. ZONING HEARING CONTINUED Mayor McClellan announced Council would hear the following zoning application scheduled to be heard at 3:00 P.M. Lamar Amendment to Restrictive Covenant RECOMMENDED GRANTED AS RECOMMENDED; WORK WITH CONCURRENCE OF URBAN TRANSPORTATION & WALNUT CREEK Ρ.Τ.Α. ON WALKWAY DESIGN Mr. Lillie reviewed the application of the hearing which was a continuation of the hearing begun two weeks ago. He said it is not recommended to open Motheral St. and stated applicant agrees to have a sidewalk across the property. Mac Holder, representing the applicant, showed a map of the area showing the proposed walk. Ada Minor, 504 Applegate, appeared & opposed the proposition. She said a street would be safer for children to cross than using a sidewalk. Mayor McClellan could not see how that could be. Sandy Levig, principal of Walnut Creek School, said his concern is for the safety of the children. Sam Gonzales, who has a construction business on Motheral said he was told the street would be open. Kathleen Hall, 507 Applegate, thinks the street would be safer than walkway. Mac Holder said the sidewalk would allow pedestrian access to the school. Councilmember Urdy said if Motheral is opened there will be more truck traffic through the neighborhood.. (On Councilmember Mullen's motion, Councilmember Duncan's second, 7-0 Vote) Council Memo 13 PUBLIC HEARING - HANDICAPPED PARKING REQUIREMENTS March 11, 1982 Mayor McClellan opened the public hearing scheduled for 3:30p.m. on proposed amendments to Chapter 13-2-101(e) (5) Zoning Ordinance of the Austin City Code pertaining to handicapped parking requirements. Jim Nias, Assistant City Attorney, told Council this is an amendment to the City Code which is basically "just a clean up of it, a provision which has already been invalidated and pre-empted by State law. An amendment passed by the last legislature took the regulation of handicapped parking out of the hands of local government and set up a state-wide system regulating it. All this does is take a local provision out of the City Code." Pat Pound appeared before Council and said there are a number of problems with the Bill as it ended up. She said in Beaumont they are electing to rearrange their ordinance to suggest voluntary compliance but not to mandate compliance. She said this would be in line with the new State law that is causing the difficulty. Ms. Pounds told Council she had received the information concerning Beaumont from Austin's former Director of Transportation, Mr. Ternus. She said the point is, if you keep such stipulations on the books then it is easier to come back and change the wording into a mandatory compliance at a later time. Mayor McClellan said they will post that for action on next week's agenda. (Passage of voluntary compliance.) Motion The Council, on Councilmember Mullen's motion, Mayor Pro Tem Trevino's second, closed the public hearing. Action will be taken at a later date. (7-0 Vote) APPEAL RE HELICOPTER LANDING AREA Mayor McClellan opened the public hearing scheduled for 3:45 p.m. on an appeal from Mr. Joe Jerkins of the Planning Commission's decision regarding Special Permit for a helicopter landing area at 3201 Steck Avenue. (File No. C14p-81-093) Mr. Tom Curtis, representing the applicant, said Channel 24 KVUE TV station was not aware, when it bought their helicopter, that they needed a Special Permit. They only land at the Steck Avenue address 3-4 times a day. He said it is a safe operation and no noisier than a home lawn mower. Rubin, 8100 Vinewood Lane, said her property borders the site. She said she does not understand the need to land in her neighborhood and 15-20 neighbors are opposed. She is concerned with safety because a day care center is next door to the site. The noise is annoying but she is mainly concerned with safety. Mrs. Morgan who said she owns a business in the neighborhood, spoke in favor of the helicopter landing site. Roger Guellenbeck, 8308 Rockwood Lane, said the helicopter in the neighborhood is a nuisance and there is great potential for an accident. Council Memo APPEAL - (Continued) 14 March 11, 1982 Frank Ivy, 8102 Rockwood Lane, said the helicopter would be a hazard to traffic, children and residents. He asked Council to vote against. Tom Curtis told Council the site had been studied by FAA and it had been determined it was within safe helicopter operations. Mr. Ashworth, pilot of the helicopter, said he has piloted since 1968. He said he has not flown over any homes and will not land if it is not safe. Motion The Council, on Councilmember Mullen's motion, Councilmember Deuser's second, closed the public hearing and approved the Special Permit with the stipulation KVUE complies with criteria when the new Zoning Ordinance is approved. (7-0 Vote) Sale of Beer Approved The Council, on Mayor Pro Tem Trevino's motion, Mayor McClellan's second, approved the request of Mr. Madison Sink, for the sale of beer at Auditorium Shores on May 9, 1982 for Austin Blues & Heritage Festival. Councilmember Deuser asked where and when the PUD signs were posted. Mr. Lillie handed him information which indicated where, on November 10, 1981, Councilmember Goodman asked if the signs were actually posted. Mr. Lillie said the fee was paid for the staff to put up signs but he could not confirm at the moment if the signs actually were put up. Assistant City Attorney Jim Nias said the hearing could not be resolved until the question of the posted signs is solved.
