Urdy Nicholas M. Meiszer City Manager Grace Monroe City Clerk Mayor McClellan called to order the Special Called Meeting of the Council, uncil, noting the absence of Councilmembers Urdy and Goodman. The Mayor yor announced the purpose of the meeting is to conduct a public hearing on the annexation of 585 acres of land along IH-35 South and along FM 1327 East of IH-35. She said this is a strip annexation with the primary purpose being to protect the Extra Territorial Jurisdiction for the City of Austin. She said it is a full purpose annexation but it is right down the middle of the roadway. Mr. Lillie, Director of Planning, explained: "The Council has asked that the City limits of the City of Austin be extended southerly to the edge of the City's Jurisdiction along IH 35. The map that I have given you shows a strip of land extending approximately 5 miles down IH 35 and a minimum of 500' in width just past the 1327 intersection with IH 35 and then easterly on 1327 about a mile. There are several purposes to this annexation. One is to extend the City's ETJ into Hays County and basically surrounding the new community of Creedmore, Buda and Hays. What that means is that before those communities expand anymore they will have to come through the City Council of the City of Austin for approval. Second, the annexation will provide an opportunity for the City to extend zoning ordinance standards and building ordinance standards along the frontage of the highway. What the Zoning Ordinance does is regulate land use, so any use that is currently being made of property, if it's commercial like Stop and Go, industrial or multi-family or restaurant, all those uses can continue to remain as non-conforming uses. If you intend to expand the use you would have to get a zoning change approved by the City Council. If you intend to build on your property along the highway within 200' of the right-of-way line, you would have to get a building permit from the City of Austin Building Department. Now, there are two types of annexations that the City can follow. One is called full purpose annexation which means the City will extend certain services to the area, certain services mean Fire, Police, EMS and garbage collection and may mean utility extension, electricity, water and wastewater. According to the State law the City has to develop a service plan if the City is going annex for full purpose and I have a copy of the Council Memo 2 April 14, 1982 5:00 p.m. proposed Service Plan. Jim Nias with the Legal Department is handing them out. The annexation must be at least 500' wide but the annexation is 200' from the rightof-way line, not the center line, of the highway." Mr. Lillie then read the following: : a. Police 1 b. c. Patrolling, response to calls and other routine police services using present personnel and equipment will be provided within 30 days of the effective date of annexation. Fire Fire protection by the present personnel and equipment of the Fire Department, within the limitations of available water, will be provided within 30 days of the effective date of annexation. Response time for the area will be from approximately 4 minutes to 12 minutes. Solid Waste Collection The same solid waste collection service now provided within the City will be extended to the annexed area within 30 days of the effective date of annexation. d. Maintenance of water and wastewater facilities. e. f. Routine maintenance of existing public water and wastewater facilities will begin within 60 days of the effective date of annexation. Maintenance of roads and streets. Routine maintenance of public roads and streets on the same basis as in the present City will be provided within 60 days of the effective date of annexation. Maintenance of public parks, playgrounds, swimming pools, and any other Parks and Recreation Department facility or building. The same standards and polices now used in the present City will be followed in maintaining and expanding the parks and recreation program and facilities in the enlarged City. : i Council Memo 3 April 14, 1982 5:00 p.m. : g. Extension of Capital Improvement Projects. The City of Austin does not deem it necessary to acquire or construct any capital improvements for providing service in the area within 2½ years. Services will be provided in accordance with the established policies of the City after completion of the Onion Creek Wastewater Treatment Plant, and improvements to the South Water Distribution System. Mr. Charles Nichols, representing the Heep Properties, asked questions concerning the map. The Mayor told him it is important for the City of Austin to not be ringed by incorporated areas. Mr. Jim Nias, Assistant City Attorney, pointed out that the Service Plan is negotiable and that is why there is a public hearing. He said the City can not take away from the plan but they can add. A man who did not identify himself said if he had wanted to live in Austin he would have instead of beyond the City limits. The Mayor explained that development control is good for the tax base of the City of Austin and will prevent the deterioration of the City. An unidentified citizen questioned water service, Mayor McClellan said that hopefully the City will have a successful bond election in the summer. Someone questioned zoning and why, if something is already obytously commercial, it will not come in as such. Mr. Nias said all land annexed comes in on the Interim residence level. Councilmember Deuser said that the exertion of City control is a plus factor. They are able to to get public input. Mr. Nichols asked if cattle can be kept within the City limits.
