Meiszer City Manager Grace Monroe City Clerk Memorandum To: Mayor McClellan called to order the meeting of the Council at 4:45 p.m., noting the absence of Councilmember Urdy, who arrived at 4:49 p.m; Mayor Pro Tem Trevino, who arrived at 4:50 p.m. and Councilmember Goodman, who was absent for the day. Mayor McClellan announced the purpose of the meeting is for consideration of first reading of an ordinance annexing a strip of land containing approximately 212 acres along Highway 290 to its intersection with Highway 71 near Oak Hill. Councilmember Duncan said he was made aware last Thursday that today is the last possible date for the beginning of annexation proceedings without starting the whole process over again. He said the citizens of Oak Hill are working on a full service annexation plan. The City needs to keep the option open to annex the strip of land and should pass the ordinance on first reading today. citize Motion Councilmember Duncan made a motion, seconded by Councilmember Mullen to pass through FIRST READING of an ordinance annexing a strip of land containing approximately 212 acres along Highway 290 to its intersection with Highway 71 near Oak Hill. Mayor McClellan said she is concerned with the inadequacy of the service plan. She favors annexation at the right time. Mayor McClellan said she was left with the impression after the last meeting on annexation that the City would not do strip annexation at this time. She summarized the transcript of the public hearing and said she feels the facts have not changed since May 27th. She asked the City Attorney what the liability of the City of Austin is. Councilmember Mullen said his interpretation was that was meant only for that day. He said he thought it was interesting how 2 Council Memo July 6, 1982 "we can all sit in a meeting and get a little different perspective." Mayor McClellan said any time they have a meeting on annexation and intend to a annex they request the staff to come back and prepare prepare that area. This was not done. Mr. Albert DeLaRosa, City Attorney, said State law allows for different levels of services. The final service plan must be attached to the ordinance. At this time we anticipate lesser levels of fire and EMS services than the proposed area of annexation in Oak Hill now has. (Mr. DelaRosa did not have his microphone on so his exact words at this point cannot be quoted.) Councilmember Duncan stated he is committed to annexing the whole Oak Hill area with full services. Mayor McClellan said she will vote "No" on annexation because she does not yet know what the service plan will be. Mr. Lillie, Director of Planning, said it would be helpful if Council will give guidelines on the level of service. Mayor McClellan said she is concerned because the City cannot serve Oak Hill at the level they are presently served. Councilmember Deuser said he found the service plan inadequate, and before he votes again there will have to be a new service plan. Councilmember Urdy said he wants ultimately to annex all of Oak Hill and will voted "Yes" today. His next vote will depend on the service plan.
