RETAINING WALL ON TAYLOR'S SLOUGH The following people discussed the retaining wall on Taylor's Slough: Ms. Barbara S. Hankins, Ms. Jacquieline Bloch, Mr. Dudley Houghton, Ms. Anna Brightman. All speakers are upset about the retaining wall. Acting City Manager Jorge Carrasco said staff will review the standards and report back. WASTEWATER APPROACH MAIN DISCUSSED Mr. James H. Coleman appeared before Council to discuss wastewater approach main on 19.8 acre tract on Loop 360. No action was taken. CONSENT ORDINANCES The Council, on Mayor Pro Tem Trevino's motion Councilmember Shipman's second, waived the requirement for three readings and finally passed the following ordinances in one consent motion: (7-0 Vote) Operating Budget Amendment Amended the 1983-84 operating budget by: a. ZONING ORDINANCE The Council, on Councilmember Shipman's motion, Mayor Mullen's second, passed through THIRD READING of the proposed Zoning Ordinance. (7-0 Vote) Members of the Council expressed thanks to Planning Director Dick Lillie and his assistant, Donna Kristaponis for their work on the new Zoning Ordinance. REVENUE BONDS Council had before them for consideration an ordinance authorizing the issuance of Systems Revenue Bonds" in a "City of Austin, Texas combined Utility maximum principal amount of $605,000,000. Lanny Sinkin said he has filed bribery charges against McCall, Parkhurst & Horton with the District Attorneys office. He asked Council to call a bond election and not sell bonds today. Michael T. McConnell urged Council to hold an election on bonds. Gary Johnson, secretary, Coalition for Open Government, told Council to hold a bond election, that they do not want to have to have a recall election. Mary Akin wants the City to default on STNP. Pat Akin and Tom Cook oppose the issuing of revenue bonds without election. The following people also spoke against the issuing of revenue bonds without an election: Darrell Fletcher, Steve Viers, Regina Schultz, Nina Butts, Jane Warren, Shudde Fath, Elliott Naishtat, Smoot Carl-Mitchell, Fred Ebner, Bill Simmons and Dave Elliott. Councilmember Shipman said this Council inherited a bad economic liability. It is a hard decision but she does not want to raise electric rates again. Councilmember Spaeth agreed. He supports cancellation but said default is out of the question. Councilmember Duncan said there is no other option but to sell bonds. Councilmember Rose said electric rates cannot be increased further. Councilmember Urdy said electric rates should not be raised except as a last resort to prevent default. Mayor Mullen said if a lawsuit is filed, then the bills will go up. Motion The Council, on Councilmember Spaeth's motion, Mayor Mullen's second, closed the public hearing. (7-0 Vote) Council Memo BONDS (Continued) 9 Motion 3/1/84 The Council, on Councilmember Spaeth's motion, Mayor Pro Tem Trevino's second, waived the requirement for three readings and finally passed an ordinance authorizing the issuance of "City of Austin, Texas, combined Utility Systems Revenue Bonds" in a maximum principal amount of $605,000,000. (7-0 Vote) MOCKINGBIRD HILL Council had before them for consideration an ordinance to extend the moratorium on move-on's and new building in the Mockingbird Hill Area. Ted Davis spoke in favor of the new systems. Kathleen Hall has two houses in the area and wants development allowed. Bea Klingman, Mockingbird Hill Neighborhood Association wants the moratorium extended and no more septic tanks allowed. Jim Melching supports the neighborhood. Gloria Aleman does not want any new building until problems of the are are solved. John Cartwright said a moratorium is needed. Jeannette Klotz supports the moratorium. Motion The Council, on Councilmember Shipman's motion, Councilmember Duncan's second, requested the City Attorney to draft a moratorium ordinance. (7-0 Vote) PUBLIC HEARING NORTHTOWN MUD Mayor Mullen opened the public hearing set for 2:30 p.m. on consideration of Northtown MUD. Mr. Lillie reviewed the application. Mary Arnold appeared and expressed distress that no alternatives are offered to creation of the MUD. Ed Wendler, representing applicants Bill Gunn and Bill Milburn said the Water and Wastewater Commission recommends the creation. Motion The Council, on Mayor Pro Tem Trevino's motion, Mayor Mullen's second, closed the public hearing. (7-0 Vote) Council Memo 10 3/1/84 BRACKENRIDGE 2000 PROJECT The Council, on Mayor Pro Tem Trevino's motion, Councilmember Duncan's second, adopted a resolution authorizing JV-5 (Joint Venture Five) for architectural services in connection with the Brackenridge 2000 Project. CAPITAL IMPROVEMENTS PROGRAM No. 84/84-01. (4-3 Vote, with Mayor Mullen, Councilmembers Shipman and Spaeth voting No.) Prior to the vote there was discussion concerning the selection since JV-5 was not the prime recommendation, Barnes, Landes, Goodman and Youngblood were. George Nalle Jr. asked Council to give the contract to someone else because BLGY designed the Travis County Jail. Mr. Ridings, Director of Public Works, said that problem arose from engineering design, not architectural. He said there are not similarities in the two projects and BLGY should not be penalized. Jim Pfluger recommended that the project might be separated into several parts. Mr. Spurck, Director of Brackenridge Hospital, said the project needs to be handled by one group and does not recommend a division. Concern was expressed about rotating work among the community. PUBLIC HEARING VACATION OF STREET Mayor Mullen opened the public hearing set for 3:00 pm. on vacating the following and passage of ordinance: A portion of Wabash Avenue right-of-way, 3300 block, as requested by Mr. George Warren. No one appeared to be heard. Motion The Council, on Councilmember Shipman's motion, Councilmember Spaeth's second, closed the public hearing, waived the requirement for three readings and finally passed an ordinance vacation a portion of Wabash Avenue right-of-way, 3300 block. (6-0 Vote, Councilmember Rose was out of the room.)
