Council Chambers, 307 West Second Street, Austin, Texas Memorandum To: - JUNE 25, 1985 Mayor Cooksey called to order the Special Called Meeting of the Council, noting the presence of all Councilmembers. The Mayor stated the purpose of the meeting is to have public hearings on four annexations as follows: a. Davis Springs MUD full purpose annexation of 690 acres in Williamson County, Texas within Austin's ETJ. Conversion from limited to full purpose 34 acres of land along portions of FM 620 and Tom Kemp Lane. C7a-85-011. b. Full purpose annexation of 9.7 acres of land out of the John C. Brooke Survey 53 in Travis County, Texas. (Portion of Quail Hollow, Section 6-A) C7a-85-002. c. d. Full purpose annexation of 520 acres along the US Highway 183 corridor south to Austin's existing five-mile ETJ in Travis County, Texas. C.7a-85-021. ! Full purpose annexation of Travis Country subdivision and MoPac Expressway extension from Barton Creek to Hwy. 290 West, 874 acres in Travis County, Texas. C7a-85-022. Council discussed each annexation separately. Catherine Loayza, OLDS,, described Davis Springs MUD & Proposed zoning will occur She said a July 11 said the statute requires it be annexed into the City before the state can approve it. concurrently with the annexation. Council Memo 2 6/25/85 public hearing of the Council should be held to consider the permanent zoning of Davis Springs MUD and after the area has been annexed it will be permanently zoned on July 25, 1985. No one appeared to speak. Motion The Council, on Councilmember Rose's motion, Councilmember Humphrey's second, closed the public hearing on Davis Springs MUD. (7-0 Vote) ------ C Mayor Cooksey announced the next hearing would be on the John C. Brooks Survey 53. Catherine Loayza reviewed and said it would complete the City's annexation goals in the northern area of the City. It is part of the North Lamar study area. No one appeared to be heard. Motion The Council, on Councilmember Shipman's motion, Councilmember Carl-Mitchell's second, closed the public hearing on full purpose annexation of 9.7 acres of land out of the John C. Brooke Survey 53 in Travis County, Texas. (7-0 Vote) - --------- Mayor Cooksey said the full purpose annexation of 520 acres along the US Highway 183 would be heard.next. Catherine Loayza reviewed. She said this area is proposed for annexation in order to completely encompass the City's proposed long range water and wastewater service area boundaries. Alton B. Law Jr., Mustang Ridge, Texas, told Council there is an area of 183 and Highway 21 south which has been proposed for incorporation. He said there are 1155 acres including the 183 and 21 intersection to be called Mustang Ridge, Texas. "The Commissioner's Court in Caldwell County, the County Judge F. Scott, have approved this and the election has been called for August 10, 1985. At this point it looks like everybody is in favor of the incorporation." Mayor Cooksey asked staff if they are aware of this. Mr. Duncan, Director of OLDS, said they were made aware of this by the City of Lockhart as this has been filed in Caldwell County. "We would appreciate a copy of your map. We have not received that yet. But we are aware of your incorporation efforts. It is my understanding that it is totally in our proposed ETJ that would be created by this Council Memo 3 6/25/85 annexation before the Council today." Mr. Law inquired how this would affect their plans. Paul Isham, City Attorney, stated, "I think you go back to the first in time rule and I think as long as the area is within the proposed ETJ and not within the proposed annexation that they can go forth in their incorporation." Mr. Law said according to their legal experts "we are perfectly legal in all aspects of incorporation. We do have another problem, maybe. We do want to be a good neighbor. The Creedmore-Maha Water Supply Corporation has 125 miles of waterlines. They come up to almost the rodeo arena out on 183 and according to Federal law we are well protected from any encroachment on our rights as it relates to supplying water in that area. We do have an extensive water expansion program. are building new water towers in the area. We hope we can work with you on any expansion you have as it relates to water and other utilities out there. We do have a proposal to perhaps build a sewage treatment plant in the area and progress as a modern little city out there.." Motion We The Council, on Councilmember Carl-Mitchell's motion, Councilmember Shipman's second, closed the public hearing on full purpose annexation of 520 acres along the U.S. Highway 183 corridor south to Austin's existing five-mile ETJ in Travis County, Texas. (7-0 Vote) ----------------- Mayor Cooksey announced the next hearing on full purpose annexation of Travis Country Subdivision and Mopac Expressway extension from Barton Creek to Hwy. 290 West. Catherine Loayza reviewed. Larry Furrow, president, Travis Country Homeowners Association, said they are neutral on the annexation question. Mr. Furrow said they have two points they would like the Council to consider if they decide to annex. One is, if the area is developed in single family dwellings around them, they would like to have any greenbelt amenity areas annexed into their association. Two, they are a non-profit association serving the homes out there and do not make any income off of their property and cannot utilize it for future development. The majority of their property is in the 100 year flood plain and as such request the Council to consider, upon annexation, that the land either be exempted from the tax roll for a set period of years, or at least evaluate it at a lower rate than is currently utlized in the City of Austin. Mayor Cooksey told him the City of Austin is not responsible for taxes and that he should contact the Travis County Appraisal District. Robert Broner and Bert Cromack both spoke in favor of annexation. : Council Memo 4 6/25/85 Col. David Bucks asked that the annexation area be designated for single family homes. Motion The Council, on Councilmember Humphrey's motion, Councilmember Carl-Mitchell's second, closed the public hearing on full purpose annexation of Travis Country Subdivision and Mopac Expressway extension from Barton Creek to Hwy. 290 West, 874 acres in Travis County, Texas. C7a-85-022. (7-0 Vote) EXECUTIVE SESSION Mayor Cooksey announced Council would go into executive session pursuant to Article 6252-17, Texas Revised Civil Statutes Annotated, to discuss the following matters; and action, if any, on the matters will be taken during the public meeting after the conclusion of the Executive Session: a. Board and Commission Appointments b. Personnel Matters - - Section 2, Paragraph g. Section 2, Paragraph g. c. Pending Litigation, including but not limited to the - following items d. - Section 2, Paragraph e. (1) Houston Lighting and Power Company, et al v. Brown and Root, et al in Matagorda County, and City of Austin vs. Houston Lighting and Power Company in Travis County - Section 2, Paragraph e. (2) City of Bastrop v. City of Austin, Section 2, Paragraph e.
