MINUTES APPROVED The Council, on Councilmember Humphrey's motion, Councilmember Rose's second, approved minutes for regular meeting of January 22, 1987 and special meeting of January 20, 1987. (4-0 Vote, Mayor Pro Tem Trevino, Councilmember Urdy and Councilmember Carl-Mitchell absent.) CITIZEN COMMUNICATIONS Mr. Sam A. Hoerster III discussed amending the AIDSOrdinance. Mr. Mark Goodrich discussed waiving provisions of the right-of-way ordinance for property located at U.S. 290 East at Giles Road. Mr. John Sanford discussed moving Robert Mueller Airport. Mr. James Austin Pinedo did not appear. Ms. Janet Klotz talked about issues related to the Office of Land Development Services. Ms. "T" Galyean will appear on February 5, 1987. Steve Sawyer discussed City personnel policy related to the Resource Management Department and Resource Management Commission. Nadia Bice talked about Affordable Housing Bond Election. Cynthia Valadez talked about existing housing crisis in Austin and and requested uniform application procedures for boards & commissions. Richard Battle discussed Affordable Housing Bond Election. CABLE COMMISSION FIFTH YEAR PERFORMANCE REPORT Jack Hopper and Michael Kuha presented the Fifth Year Performance Report of the Cable Commission. ) Council Memo ITEMS POSTPONED 2 1/29/87 Mayor Cooksey announced consideration of a resolution to award a contract for the Housing & Economic Development Fund sponsored by the 12th Year CDBG Program; as well as an item from Councilmember Carl-Mitchell to consider approval of an RFP for Sustainable Industries Proposal, were postponed. EXECUTIVE SESSION - Fifth Year Performance Report Mayor Cooksey announced Council would go into executive session pursuant to Article 6252-17, Texas Revised Civil Statutes Annotated, "to discuss the Cable Commission issues insofar as they relate to possible land acquisition litigation or personnel matters and that we will also briefly discuss in executive session, pending litigation, including Marsh v. City of Austin, City of Austin v. Valero, City of Austin v. Houston Lighting and Power. We may want to take some of those items up later as well. RECESS Council recessed its meeting for executive session at 3:50 p.m. and resumed its recessed meeting at 5:15 p.m. CITY OF AUSTIN v. VALERO Mayor Cooksey stated Council had a resolution to adopt as a result of discussion during the executive session. Motion -Councilmember Shipman made a motion, seconded by Councilmember Rose, to adopt a resolution as follows: (6-0 Vote, Councilmember CarlMitchell absent.) The City Manager, or his designee, is hereby authorized to execute the following agreements related to and in settlement of Railroad Commission, Gas Utilities Dockets No. 5980 and 6336, involving the City of Austin and Valero Transmission Company. (1) Gas Sales Contract No. 6100134 between Valero Transmission Company and the City of Austin. Gas Sales Contract No. 8173 between Reata Industrial Gas Company and the City of Austin, and Gas Transportation Agreement No. 5202270 between Valero Transmission Company and the City of Austin. Councilmember Shipman said the action will save the citizens of Austin hundreds of millions of dollars "and we can be proud of the City for negotiating this successful contract that is advantageous to the consumer." Postponed until February 5, 1987 is consideration of a resolution extending the Affirmative Action Plan Task Force for 90 days to complete the revision to the City's Affirmative Action Plan. Postponed to February 5, 1987 is consideration of a resolution supporting a cooperation agreement between the City of Austin and the University of Texas regarding the Blackland Neighborhood. Postponed to February 5, 1987 is discussion of the STNP Cancellation Campaign. Continued to February 5, 1987 at 4 P.M. is a public hearing on amendments to the Zoning and Subdivision Ordinance. Aldridge City Clerk RESCINDING DENIAL OF ZONING REQUEST Mayor Cooksey opened the public hearing on rescinding denial of the request for zoning change for property located at 2658-2712 Capital of Texas Highway South, to wit: The Barton Creek Office Pud, which request was denied on the 4th day of December, 1986. Jonathan Davis, Deputy City Attorney, said this has already gone through the Planning Commission "so there would not be any change there. The only action would bring it back to the Council....it would Council Memo 14 1/29/87 need to be re-advertised and re-published." Mayor Cooksey asked if the case would have to be presented again. Councilmember Shipman said, "It wasn't presented before. As I recollect the gentleman had to leave the meeting. It was late when it came up on the agenda. The applicant wasn't here and we denied the request." Motion Mayor Pro Tem Trevino made a motion, seconded by Councilmember Rose to rescind the previous vote and re-open the public hearing with re-advertising and re-publishing. Motion passed by a vote of 6-0 with Councilmember Carl-Mitchell absent. APPEAL WITHDRAWN A 4:30 public hearing on an appeal of the Planning Commission's denial of two Barton Creek related watershed variances was cancelled when the applicant withdrew his appeal. RADIO COMMUNICATIONS EQUIPMENT The Council, on Councilmember Urdy's motion, Councilmember Shipman's second, adopted a resolution approving extending for 30 days a contract with Austin Communications, Inc. for maintenance of radio communications equipment. (4-0 Vote, Councilmember Rose abstained the room, Councilmember Carl-Mitchell absent.) Mayor Pro Tem Trevino out ofPUBLIC HEARING - MINORITY AND WOMEN OWNED BUSINESS Mayor Cooksey opened the public hearing set for 6:00 p.m. on Minority and Women Owned Business Procurement Ordinance. At this time the Economic Development Commission gave its report on the subject. Speaking at the hearing were: Wilhelminia Delco, Beverly Davis, Diane Harrison, Marilyn Rickman, Sandy Walker, Norma Hudson, Ernest Chaveria, Tasha Waler, Jacqueline Williams, Martha Cotera, Lavonne Mason, Barbara Burton, Kenneth Denton, Sam Guzman, Annabella Chan, Nancy Kaufman, Michael Glarus, Major Thomas, Andy Ramirez, Jan Triplett, Judy Young, Mary Brown, Juan Cotera, Motion The Council, on Councilmember Urdy's motion, Mayor Pro Tem Trevino's second, closed the public hearing, and passed the ordinance through the first reading only. (6-0 Vote, Councilmember Carl-Mitchell absent) Work session will be held February 3, 1987 and vote will be taken on second and third readings on February 5, 1987. Council Memo EXECUTIVE SESSION : 15 1/29/87 Mayor Cooksey announced Council would enter into executive session pursuant to Article 6252-17, Texas Revised Civil Statutes Annotated, to discuss matters of land acquisition, litigation, and for personnel matters. No final action, decision or vote by the City Council will be taken on any subject or matter unless specifically listed on the agenda for this meeting. (a) Marsh v. Houston Lighting & Power RECESS : Council recessed its meeting from 8:12 p.m. to 10:05 p.m. SUBDIVISION OF DUPLEXES The Council, on Councilmember Rose's motion, Councilmember Urdy's second, passed through second reading only of ordinances (two) providing for the subdivision of duplexes and establishing zoning for subdivided duplexes. (5-1 Vote, Councilmember Shipman voted No, Councilmember Carl-Mitchell absent) Third reading will be on 2/5/87. CIVIC CENTER PROJECT Council had on its agenda a resolution to consider approval of an RFP to solicit professional services for the Civic Center Project and amend the previously adopted Civic Center District Boundaries. Motion - FAILED Mayor Cooksey made a motion, seconded by Councilmember Urdy to amend the districts east and west. Motion FAILED by a vote of 2-2 with Mayor Pro Tem Trevino and Councilmember Humphrey voting No, Councilmember Carl-Mitchell absent, Councilmembers Rose, Shipman present but not voting, and Councilmember Humphrey out of the room. Councilmember Rose said he would have to withdraw from voting on the portion of the Civic Center Project regarding the siting because his business sells plants to 301 Congress, and that building would be in the area of a new boundary. Councilmember Shipman said her husband's company may compete for the RFP on proposed civic center so she will abstain from any discussion on the civic center. The part of the resolution concerning the RFP will be brought back to the February 5, 1987 Council Meeting. ADJOURNMENT - Council adjourned its meeting at 12:00 midnight.
