Council Memo 11 2/19/87 PROCESSING AMENDMENTS TO AUSTIN METROPOLITAN ROADWAY PLAN Councilmember Rose introduced an item to Council to consider Council's direction to staff regarding processing amendments to the Austin Metropolitan Area Roadway Plan. After discussion the following motion was made: Motion The Council, on Councilmember Rose's motion, Councilmember Carl-Mitchell's second, approved the time chart and process for amendments to the Austin Metropolitan Area Roadway Plan. (7-0 Vote) POLICY AGENDA The City Council's Policy Agenda was discussed at the February 17, 1987 special called meeting. ITEM CONTINUED Continued until February 26, 1987 are consideration of a resolution requesting the Highway Commission to expedite the construction of Parmer Lane from FM 1325 to Highway 620. was introduced by Councilmember Shipman. SEPTIC TANKS AND CAPITAL RECOVERY FEES This item Councilmembers Carl-Mitchell and Rose introduced an item to Council concerning discussion of septic tank cut-overs and Capital Reovery Fees. Council discussed but no CITY MANAGER REPORTS action was taken. The report on finances was presented at the February 17, 1987 special called meeting. Kay Doughty gave the Legislative Update and discussed two legislative bills. One was the indigent health care bill and she suggested the best position for the City to take was to not change the program at this time. Also discussed was SB 336 which she said would have serious ramifications for the City concerning impact fees. Mayor Cooksey said a meeting should be set with Senator Farabee concerning his bill as soon as possible. A copy of the report given by John Moore, Director of Electric Utility, on Waste-to-Energy Plant Implementation Update is on file in the City Clerk's office. RECESS Council recessed its meeting at 3:45 p.m. and resumed its recessed meeting at 4:10 p.m. Council Memo LEASE FOR MINERAL RIGHTS 12 2/19/87 The Council, on Councilmember Carl-Mitchell's motion, Councilmember Rose's second, adopted a resolution to enter into a lease for mineral rights of 647 acres of Fayette Power Project property for oil and gas development. (4-0 Vote, Mayor Pro Tem Trevino, Councilmembers Urdy and Shipman out of the room) PARMER LANE Council had before them for consideration an amendment to the Austin Metropolitan Area Roadway Plan for Parmer Lane. E.G. Kirby, representing Breakaway-Whipporwill, spoke against the amendment. Linda Nieman, Breakaway Park Homeowners also spoke against the amendment, as did Dennis Haverlah, Joanne Caldarola and Chuck Speyrer. They all spoke in favor of alignment "C". Sharon Kranke also spoke in favor of alignment "C". Terry Bray, representing Mr. Wilson, who wants the amendment, spoke to Council. Motion The Council, on Councilmember Shipman's motion, Councilmember Humphrey's second, voted to maintain "C" as recommended by staff, Planning Commission and Urban Transportation Commission with the alignment the same as voted on 18 months ago. Motion passed by a vote of 5-1-0 with Councilmember Rose voting No and Councilmember Urdy abstaining. MINORITY AND WOMEN OWNED BUSINESS AND PROCUREMENT ORDINANCE The Council, on Councilmember Shipman's motion, Councilmember Rose's second, passed through second and third readings of the Minority and Women Owned Business Procurement Ordinance as submitted by Economic Development Commission and amended. ZONING FOR SUBDIVIDED DUPLEXES Council had before them for consideration the third reading of ordinances providing for the subdivision of duplexes and establishing zoning for subdivided duplexes. Councilmember Rose stated: "Each of the Councilmembers has received a memo from staff which was requested two weeks ago which looked at several different issues. There is one remaining issue or concern that I am aware of, there may be others, but the fire wall, sprinkler system Building Code amendment issue, I want to point out that we do not have the amendment to the Building Code on the agenda tonight. The process we are going through tonight is to first finally pass the subdivision ordinance and the zoning ordinance which allows for that and then the party wall agreement referenced in the ordinance will have to go through the rules process and then be adopted, or can be appealed to the Council, for establishment of a party wall. The Building Code Amendment and the issue of sprinklers and fire wall and liability question that staff has raised will come when the Building Code amendment is adopted. I will put that on next weeks agenda so we can close this process....." Councilmember Rose asked for a written opinion from the City Attorney concerning liability for the party wall. Points of the ordinance were then discussed. Individuals who spoke in favor of the ordinance were Leo Bouton, Pat Burnett, Chuck Hempstead, Beth Holt, Dale Jarmush, Patricia Linn and Mary Lou Shirer. Those against the ordinance were Bill Shopoff, Terry J. Sasser, Dorothy Richter, Dudley Houghton, Chip Harris, Martin Gonzalez, and Rich Ellmer. Motion The Council, on Councilmember Rose's motion, Councilmember Carl-Mitchell's second, passed through third reading of ordinances providing for subdivsion of duplexes and establishing zoning for subdivided duplexes as outlined in the February 18, 1987 draft ordinance, with friendly amendments by Councilmember Shipman: (1) In six months Planning Commission shall report to Council on the effectiveness of the ordinance, (2) There shall be a one year review by staff. (7-0 Vote) COAL CONTRACT The Council, on Councilmember Carl-Mitchell's motion, Mayor Pro Tem Trevino's second, adopted a resolution entering into a contract with the Burlington Northern/Missouri, Kansas, Texas Railroads for coal transport. (6-0 Vote, Councilmember Rose out of the room) Council Memo EXECUTIVE SESSION 14 2/19/87 Mayor Cooksey announced Council would go into executive session pursuant to Article 6252-17, Texas Revised Civil Statutes Annotated, to discuss matters of land acquisition, litigation, and for personnel matters. No final action, decision or vote by the City Council will be taken on any subject or matter unless specifically listed on the agenda for this meeting. 1.
