FOUNDED 1830 Austin City Council MINUTES For - SPECIAL CALLED MEETING May 09, 1988 11:45 Α.Μ. Council Chambers, 307 West Second Street, Austin, Texas Memorandum To: - CANVASSING Mayor Cooksey called to order the special called meeting of the Council, noting the absence of Councilmembers Carl-Mitchell and Humphrey. Mayor Cooksey announced the purpose of the meeting was to canvass the returns and declare the results of the May 7, 1988 General Municipal Election, and to consider calling a runoff election for Saturday, May 28, 1988. Motion The Council, on Mayor Pro Tem Trevino's motion, Councilmember Shipman's second, adopted a resolution canvassing the returns and declaring the results of the May 7, 1988 General Municipal Election. (4-0 Vote, Councilmembers Carl-Mitchell and Humphrey absent, Councilmember Urdy out of the room) (See resolution attached) Motion The Council, on Councilmember Shipman's motion, Mayor Pro Tem Trevino's second, waived the requirement for three readings and finally passed an ordinance calling a runoff election for Saturday, May 28, 1988. (5-0 Vote, Councilmembers Carl-Mitchell and Humphrey absent) ADJOURNMENT Council adjourned its meeting at 12:09 Ρ.Μ. - RESOLUTION A RESOLUTION by the City Council of the City of Austin, Texas, canvassing returns and declaring the result of an election held in said City on the 7th day of May, 1988 WHEREAS, this governing body ordained that an election be held within this City on the 7th day of May, 1988, for the purpose of electing the Mayor and three Council Members of the City of Austin, and for the purpose of submitting one Proposition relating to a proposed amendment of the City Charter to the resident electors of the City; and, WHEREAS, it is hereby found and determined that said election was held in accordance with the authorizing proceedings, that notice of the election was duly given in the form, manner and time required by law, and that said election was in all respects legally held and conducted in accordance with the laws of the State of Texas applicable thereto; and, WHEREAS, the returns of the said election have been made to this governing body and said returns, duly and legally made, show the following votes were cast for the offices of Mayor and Council Member and the Proposition submitted at said election, to wit: : Mayor Votes Carl Hickerson-Bull 455 : Jeff Friedman 14,287 Richard Shield 812 Rick Martinez 498 Mike Poulson 1,600 Frank C. C FOR AGAINST TOTAL VOTES CAST 25,457 34,398 59,955 AND WHEREAS, it appears that Smoot Carl-Mitchell and Charles Urdy have received a majority of all votes cast at said election for the respective offices of Council Member, Place No. 2 and Place No. 6; and WHEREAS, no candidate received a majority of all votes cast at said election for the office of Mayor; and WHEREAS, the Charter of the City of Austin provides that where, in an election to a place on the Council, no candidate receives a majority of all votes cast, the Council shall, immediately upon declaring the official results of the election, issue a call for a run-off election for the office to which no one was elected; Now, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN, TEXAS: That all of the recitals contained in the preamble of this resolution are found to be true and adopted as findings of fact by this governing body and as part of its judgment; : It is further found and determined that the results of the election as canvassed and tabulated in the preamble hereof reflect the expressed desires of those persons voting at said election; and, BE IT FURTHER RESOLVED BY THE CITY COUNCIL: That in accordance with said return, the following persons are hereby declared to be the two candidates who received in said election the highest number of votes cast for the offices indicated: Mayor Frank C. Cooksey Lee Cooke Place No. 5 Sam Guzman Robert Barnstone BE IT FURTHER RESOLVED BY THE CITY COUNCIL: That in accordance with said return, as received and canvassed, the Council hereby accepts and approves same, and the following named persons are hereby declared duly elected and authorized to quality for the offices indicated for three-year terms commencing June 15, 1988: Council Place No. 2 Council Place No. 6 Smoot Carl-Mitchell Charles Urdy ADOPTED: May 9, 1988.
