POUNDID 1039 Austin City Council MINUTES For July 31, 1989 SPECIAL CALLED MEETING 11:00 Α.Μ. Council Chambers, 307 West Second Street, Austin, Texas Mayor Cooke called to order the special called meeting of the Council, noting the absence of Councilmember Carl-Mitchell. Mayor Cooke announced the purpose of the meeting was to consider a resolution canvassing the returns and declaring the results of the July 29, 1989 special municipal election. Motion The Council, on Mayor Pro Tem Shipman's motion, Councilmember Humphrey's second, adopted the following resolution canvassing the returns and declaring the results of the July 29, 1989 Special Municipal Election. (6-0 Vote, Councilmember Carl-Mitchell absent) C RESOLUTION A resolution by the City Council of the City of Austin, Texas, canvassing returns and declaring the result of a election held in said City on the 29th day of July, 1989. WHEREAS, this governing body ordained that an election be held within this city on the 29th day of July, 1989, for the purpose of submitting certain propositions to the resident electors of the City; and WHEREAS, it is hereby found and determined that said election was held in accordance with the authorizing proceedings, that notice of the election was duly given in the form, manner and the time required by law, and that said legally held and conducted in the State of Texas applicable election was in all respects accordance with the laws of thereto; and WHEREAS, the returns of the said election have been made to this governing body and said returns, duly and legally made, show the following votes were cast on the propositions submitted at said election, to-wit: PROPOSITION SHALL THE CITY OF AUSTIN, TEXAS BE AUTHORIZED TO CONSTRUCT A NEW CIVIC/CONVENTION CENTER ON THE EAST SIDE OF DOWNTOWN BY THE ISSUANCE OF REVENUE BONDS IN AN AMOUNT TO BE LIMITED BY THE ABILITY TO REPAY THE OBLIGATION FROM THE PROCEEDS OF CIVIC/CONVENTION CENTER REVENUES AND 4.54 FROM THE HOTEL/MOTEL BED TAX AND SHALL NOT EXCEED $69,000,000; AND NOT BE AUTHORIZED TO USE GENERAL FUND MONEY, INCLUDING PROPERTY TAX PROCEEDS, IN CONSTRUCTING OR OPERATING A NEW CIVIC/CONVENTION CENTER? FOR AGAINST 26,527 votes 20,569 votes ! ! 1 : ! TOTAL 1 47,096 votes C NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: Section 1. That all of the recitals contained in the preamble of this resolution are found to be true and are adopted as findings of fact by this governing body and as a part of its judgment. Section 2. It is further found and determined that the results of the election as canvassed and tabulated in the preamble hereof reflect the expressed desires of those persons voting at said election. Section 3. That a majority of the resident qualified electors voting at said election having voted in favor of the proposition, the City Council of said City is authorized and empowered to issue bonds on behalf of said City in the amount and for the purposes prescribed in the proposition in the proceedings calling the election.
