AUST jo FOUNDED Fas Austin City Council MINUTES For December 18, 1990, SPECIAL CALLED MEETING 4:00 Ρ.Μ. Mayor Cooke called to order the Special Called Meeting of the Council, noting the absence of Councilmember Barnstone. ORDINANCES .1 North Central Growth Corridor MUD No. 1 1. Approved annexation of the North Central Austin Growth Corridor Municipal Utility District No. 1 and four outlying parcels. On Councilmember Carl-Mitchell's motion, Councilmember Nofziger's second, 6-0 Vote, Councilmember Barnstone absent. 2. Approved assessment and imposition of a surcharge of $7.95 per month on the residents of the area within the boundaries of the North Central Austin Growth Corridor Kunicipal Utility District No. 1. On Councilmember Nofziger's motion, Mayor Cooke's second, 5-1 Vote, Councilmember Epstein voted No, Councilmember Barnstone absent. RESOLUTIONS 3. 4. 5. Authorized the negotiation and execution of an Interim Operating Agreement between the City of Austin, the North Central Austin Growth Corridor Municipal Utility District No. 1 (MUD) and Am-Tex to provide for an orderly transition between the time of dissolution of the MUD and the provision of all City services by the City of Austin. Authorized the assignment from the MUD to the City of Austin of a contract with Pampered Lawns-Austin, Inc. for the continuation of parks maintenance in the MUD area for a period of one year, with a right to extend for one year. Authorized an orderly and efficient transition for the provision of City services to the MUD area and to notify all appropriate entities and authorities of the City's annexation of the area. 13-5 on Councilmember Carl-Mitchell's notion, Mayor Pro Tem Urdy's second, 6-0 Vote, Councilmember Barnstone absent. 1 12/18/90 6. - C14r-85-144 TRAMMEL CROW COMPANY, by Robert Liverman, 9811-9900 Research Blvd. (Amendment to Restrictive Covenant). Planning Commission Recommendation: No recommendation due to lack of a quorum vote. No Action Taken EXECUTIVE SESSION Mayor Cooke announced that Council would enter into executive session, pursuant to Article 6252-17, Texas Revised Civil Statutes Annotated, to discuss matters of land acquisition, litigation and for personnel matters. No final action, decision or vote by the City Council will be taken on any subject or matter unless specifically listed on the agenda for this meeting. 7. Pending/Contemplated Litigation - Section 2, Paragraph e (a) Discussion of Airport Neighborhoods Environmental Defense Association et al v. City of Austin, Civil Action No. 494411. (b) Discussion of Sierra Club, Save Barton Creek Association, Koenig Lane Business Association, Allandale Business Association et al v. Austin Transportation Study Policy Advisory Committee et al, Cause No. 404,930. (c) Discussion of settlement of claim of Jack Gonzales v. Brackenridge Hospital civil claim.
