PLANNING COMMITTEE REPORT Report presented by Ben Heimsath, Cecil Pennington, Carroll Faulkner and various committee members ! ACTION ON THE FOLLOWING 5. Approve a resolution authorizing the City Manager to release the terms of the development agreement with Freeport McMoran to the public and establishing a public process for consideration of the agreement and any related legal settlements, including full disclosure of the fiscal impact to the City, and review by appropriate citizen boards and commissions. Councilmember Shea made a motion to approve resolution and friendly amendment of change from ten (10) working days to seven (7) in paragraph 4 offered by Councilmember Goodman, Mayor Pro Tem Nofziger's second, 3-3-1 vote, Mayor Todd and Councilmembers Mitchell and Reynolds voting NO, Councilmember Garcia abstaining. Council would take any subsequent action in the open meeting as listed on the agenda. The City Council may also announce it will go into Executive Session, if necessary, to receive advice from Legal Counsel regarding any other item on this agenda.
