FY OF AUSTI FOUNDED 1839 Austin City Council MINUTES SPECIAL CALLED MEETING August 22, 1995 Mayor Todd called the meeting to order. ORDINANCES 1. Amend Chapter 13-2, Article V and Chapter 13-7-Article I of the Austin City Code of 1992, as amended (land Development Code) relating to protection of water quality in the extraterritorial jurisdiction of the City of Austin; waiving the requirements of Section 13-1-981 regarding procedures for review and adoption of amendments to the Land Development Code; waiving the requirements of 2-2-3, 2-2-5, and 2-2-7 of the Austin City Code of 1992 as amended,, and declaring an emergency. Motion made to make all areas orange on Councilmember Mitchell's motion, Councilmember Reynolds' second. Motion fails Approve first reading only on, substitute motion by Mayor Pro Tem Garcia to make all areas purple, Councilmember Goodman's second, 4-2-1 vote, Mayor Todd and Councilmember Reynolds voting "NO", Councilmember Mitchell abstaining. 2. Approve third reading of an ordinance amending Chapter 13-2 of the Austin City Code rezoning property locally known as 4309 to 4311 Marathon Boulevard, Case No. C14-95-0053, from "SF-3", Family Residence to "GO-MU-CO", General Office-Mixed Use Combining District-Conditional Overlay with the provisions of the overlay as follows: (1) to prohibit the following uses Administrative and Business Office, Arts and Crafts (limited), Business Support Services, Business and Trade Schools, Communication Services, Medical Offices, Personal Improvement, Professional Office, Restaurant (limited), Convalescent Services, Counseling Services, Day Care (limited, general & commercial), Guidance Services, Hospital Services (limited and general), Local Utility Services, Safety Services, Cultural Services, Private Primary Education, Private Secondary Education, and Community Services Facility; (2) prohibit access to Marathon Boulevard; and (3) post fiscal to provide for a solid six foot masonry fence along the west property line; CENTRAL TEXAS REGIONAL BLOOD BANK (Trudell Green), by Ray Wilkerson Companies (Jim Spence). First reading on July 20, 1995; Vote 5-0-2, Shea and Goodman abstaining. Second reading on August 17, 1995; Vote 6-0-1; Goodman abstaining. Conditions met as follows: conditional overlay incorporates conditions imposed by Council. A Letter of Credit has been posted for the construction of the required fence. Postponed ADJOURNED at 6:30 p.m., on Mayor Pro Tem Garcia's motion, Councilmember Mitchell's second, 7-0 vote. Approved on this the 28th day of September, with corrections, to attach a map describing item #1 on Special Called Meeting of August 22, and to postpone minutes of Special Called Meeting for September 11, on Councilmember Nofziger motion, Councilmember Goodman's second, 5-0 vote, Councilmember Shea temporarily absent, Mayor Pro Tem Garcia absent.
